Once Again Accosted by Miami-Dade Metrorail Security Guards

Guards still haven't received the memo that photography is allowed

 

We knew it was too good to be true; the way Miami-Dade Metrorail security officials informed us that they are now aware of the law that states photography at transit stations is permissible.

On Thursday, I was once again accosted by a Metrorail Security Guard from 50 State who bull-rushed me as if I were a matador.

The same security guard also bull-rushed Adam Mueller from Liberty on Tour, part of the activist duo who finally made it to Miami after traveling the country for the past few months in an RV.

The guard, whose name is Carlos Rodriguez, ended up grabbing Mueller's camera, attempting to shut it down.

He also tried to grab my camera, but I'm a veteran at these situations so I stepped aside or turned my back on him like a true matador.

When he realized we were not going to allow ourselves to be intimidated, he pulled out his own cell phone camera and took our pictures.

Considering the guy was armed, we're lucky that is all he pulled out.

We both smiled for the picture. I introduced myself. Adam waved.

The above video is a compilation of the footage I shot and the footage Adam shot. Adam put it together after I dropped him off at the RV.

So what does this all mean? Well, besides constant fodder for my blog, it means that there is a serious lack of communication within Miami-Dade County Transit and 50 State Security.

Last month, after two incidents in which I was either "permanently banned" from the Metrorail or outright assaulted by a security guard for shooting video on the premises, a local representative fired off a letter of complaint to Miami-Dade County Manager George Burgess.

It took a couple of months, but Burgess eventually responded to Coconut Grove Village Councilman Stephen Murray, informing him of the following:

"MDT met with the security contractor and stressed the right of the public to photograph in the common areas of its public facilities. To that end, all contracted security officers have been retrained on the appropriate manner in which to enforce Miami-Dade County Code of Ordinances, Part III, Chapter 30B-5, governing photography on the transit system, and a copy of the aforementioned code has been placed at all MDT Metrorail security kiosks."

The right to take photographs on the Metrorail was also confirmed in a letter to the National Press Photographers Association from Eric Muntan, director of security for Miami-Dade Transit.

And it was only last month that I, along with a group of Miami photographers, visited the Coconut Grove Metrorail Station and after initially being told we were not allowed to take pictures, were informed that yes, we are allowed to take pictures inside the stations.

We were even shown a laminated copy of the law that they supposedly had placed at all the Metrorail stations.

And we were informed that every single security guard would be required to sign a notice that they are aware of the county law that allows photography and videography inside Metrorail stations.

But even then, we knew it was too good to be true.

It doesn't look like he was trying to enforce any policy. It looks like he was just personally annoyed by being video taped. This seems like you were bothering them. People generally don't like being video taped by strangers. He obviously didn't act professionally, but I wouldn't say that he was trying to stop you filming in that area. He just didn't want to be filmed. While you are not breaking the law, it is annoying to film someone for no good reason. You weren't there to film anything in particular, but you focused your cameras on the guards. I think he was acting like a normal short fused individual, not a guard on a power trip.

It may be legal to film children at a park, but if you follow one around and focus your camera on them, don't be surprised if you run into an angry parent.

You have a right to film in public. Don't ruin that right by trying to instigate.

You know Antonio I VERY much doubt that you wouldn't do lots of time for such a stupid act.

You HAVE ALMOST NO PRIVACY IN PUBLIC, nor do you have any right (nor your family) from being photographed in public. If you pull your weapon on somebody for that, it is YOU who will be going to jail, not them. It may be a bad idea to follow a family, especially one with kids around, it however isn't and can't be made illegal to do so.

What privacy? You have almost none in a public place, and what little you do have, is solely to what is inside your bags or under your clothes. Would you shoot someone for reading the slogan on your t-shirt too?

Then there's the fact that a lot of people value more than just one right out of the ten in the bill of rights. The photographer may well have a .45 of his own. In light of that, would you really want to endanger your family with the risk of his return fire missing you and hitting them? In such a situation, you'd be the one who goes to jail for attempted (or actual second degree) murder, not the photographer.

@Bob - You're confusing rights with privileges. It is the Bill of Rights, not the Bill of Privileges, and the 1st Amendment gives us the RIGHT to photograph in public. That WON'T be taken away, or "ruin[ed]" as you put it.

If you'd bothered to do any research before flapping your gums, you would know that photography falls under protections granted to free speech, which is already in the Constitution. This has been decided in several court cases.

And you apparently also have missed the part of the Constitution that just because a right isn't specifically enumerated there, it does not follow that the right does not exist.

Hey Genius, Rights can be taken away, commit a felony and see if your right to vote is not taken away.

Perhaps you should look at the supreme court and legislative history of this particular item. As well as first amendment history and supreme court precedent.

You will find that rights are not taken away lightly and only upon serious action in violation of the law bounded by the Constitution. You will also see that first amendment rights are EXTREMELY vast and cannot be taken away in almost ANY circumstance short of incarceration. Even to the point that you can embarass the government. Felons might not be able to vote or own guns, but that is about all they can't do.

What do you think would happen if you called the police in a situation like this and tried to have the guard arrested for assault? In a just and fair world I think the police would have to arrest the guard because he did assault you and the other camera man.

Then again the police would probably just invent something and arrest you...

What ever happened with the case you were going to be filing from the original metro station incident???

I actually thought he was calling the police when he pulled out his phone, but he was only taking a photo of me.

The cops would not do anything to them. That's certain.

And they would just end up wasting my time by asking me a bunch of stupid questions and probably telling me that I am breaking the law.

That's what they did the last two times.

We are filing suit on the Metrorail assault incident.

I don't know what the laws are in Florida, but in New York if you tell a cop "This security guard assaulted me, I'm pressing charges" the cop has no choice but to arrest the guard. He'll try to talk you out of it, but if you stand your ground the guard goes to a holding cell.

In West Virginia you don't even need a cop. Just visit the county magistrate and swear out a criminal complaint. Then the magistrate issues an arrest warrant.

This is not New York or Virginia

The only problem is if the guard immediately retaliates by making the same claim against you. You could wind up in the holding cell next door. Your video would exonerate you, but it's still an annoyance.

You my well end up in an ajacent cell, however he would also then be guilty of filing a false police report, which only bolsters your case. And adds ZEROES..

Annoyance is something that I am often willing to put up with. I don't take shit from ANYBODY cops included, and have more than once simply said IF YOU THINK YOU CAN ARREST ME I SUGGEST YOU DO, but you might want to get your watch commander on the radio first, because its not gonna be my ass that gets pounded for this since your qualified immunity won't cover this... I will follow all lawful and generally lawful orders, but give me an unlawful one and we are going to tangle, I might get arrested but I'm getting paid when I'm done.

I have been the Desert Rat since I was on patrol. I have posted to national police forums and publications that way. With a some sleuthing anyone can find out who I am. Furtherthermore I am better known by that call sign than by my name in many places.

As a retired LEO I know better that to post pictures, use real names, etc. Makes me seriously wonder about the training protocols in your dept.

In one sense I do understand and sympathize with you, however. You feel under siege, from a public that doesn't appreciate your contribution to public safety. Why not try something fun in response to CM and his ilk? Keep a pocket video camera of your own, and when he shows up, whip it out and start filming. Post the result, edited as YOU wish.

Speaking of which, Carlos, YG's call for an unedited version of your video(s) seems reasonable to me. Would you be willing to oblige?

Man you aren't do yourself any favors by posting on here with your real name. These folks will jump all over you for not using your name. Then when you do use your name, they immediately call your employer to report you saying something they don't like. Be careful what you say here.

Also, I think it would just be best to admit you were in the wrong on this one. Carlos was filming in an area where he is allowed to film and you tried to stop him. While trying to stop him, you grabbed one of the cameras. It's obvious you didn't want to be filmed and it's obvious that Carlos was trying to provoke a response. The video is pretty clear that you went over the line a little bit.

I've found that the best thing to do when someone sticks a camera in your face is to just ignore it. Confronting the person is just going to cause things to escalate.

Getting disciplined/fired for saying/doing/threatening things that are against your employer's policies and/or the law (no matter where you work) isn't a bug, it's a feature.
