Activist and Videographer Sue Over Assault Incident Caught on Video in Hawaii
An activist and a videographer who were assaulted outside the Hawaii state capital earlier this year have filed a lawsuit.
The incident occurred on April 29 when activist Mitch Kahle began protesting against a public prayer inside the capital by shouting that it was unconstitutional.
A group of security guards and police officers grabbed him and dragged him outside as videographer Kevin Hughes followed them with his camera.
Once outside as a group of men piled on top of Kahle, another man took a swipe at Hughes' camera.
One man can be heard saying "get that camera."
There appears to be quite a struggle, then a woman can be heard saying, "I'm going to take the camera and I'm going to put it away."
The man who punched the camera has been identified as Senate Sergeant at Arms, Bienvenido Villaflor, a former professional boxer, according to Hawaii News Now.
"When you put somebody with the training of Mr. Villaflor, who has a violent skill, and put him in charge of security, without the right training, it's a recipe for disaster," plaintiff's attorney James Bickerton said.
"The lasting effect for me, is now the understanding that I might be attacked when I go to the capitol to exercise my first amendment rights, for whatever reason that I might be there," Kahle said.
Attorney Bickerton says the photographer is still recovering from his physical injuries and suffers from

i dont think they'll win
Camera man probably will.. He was well within his rights.. More idiot security who think they can do whatever they like.. It is only worse they work for the state..
Both may stand a good chance. Kahle also did not break any laws and was within his rights to make that short (seven second) statement and then sit back down.
All camera men should be armed.
Not just camera men, every body.
Remember Henline, an armed society is a polite society.
What do you mean by Remember Henline?
that's Robert Heinlein, science fiction writer from the 50's
who was a visionary.
Ah okay, Heinlein, not Henline. I was wondering who this Henline was that I had not yet heard of and all I could find was a tech support guy, a missionary and an adhesive dude.
There are those in power that assume they can use that power in any way they see fit. Those people are NOT above the law, they should should go to jail.
The videographer was not breaking any laws, the thugs were afraid that their actions would be exposed, guess what.
They were wrong, and the guy was cordial enough to voice his dissent after their prayer inside the state building.
And when the guy is calmly and non violently leaving the building, they further escalate the situation by tackling him and the camera man? Their intention which they fulfilled was to hinder evidence gathering. That's illegal, and the prayer was illegal. These people deserve to go to jail to teach them they are not above the constitution.
America still has the Constitution? I thought that document was recycled into toilet paper quite awhile ago.
The guy wasn't "calmly" leaving. The assault on the camera guy was wrong but let's not misrepresent the facts.
No, he wasn't calm after being unlawfully grabbed and removed after his calm and lawful statement. He failed to lick the boots and badge of the stormtrooper who grabbed him. The stormtroopers, of course, had to take out the camera filming their unlawful act.
Why haven't the people who actually did break the law here been arrested and prosecuted?
Perhaps you're misinterpreting the video. He was walking out and not saying anything. How much more calm could he have been?
Fluid Ambient,
You forget.. even when "JL's" wrong he still thinks he's right. After all, don't forget his motto:
"Cops Can Do NO Wrong!!"
Actually JL is right. He didn't say the cops weren't in the wrong, he just clarified that the guy didn't go quitely.
Update on this story -- it seems the judge agreed with the activist!

yeah this is one of those rare cases where you guys are spot on. The prayer was against the law & the security guard new that what they were doing was also against the law.
You do things when the opportunities come along. I've had periods in my life when I've had a bundle of ideas come along, and I've had long dry spells. If I get an idea next week, I'll do something. If not, I won't do a damn thing. It is quite acceptable.
