Albuquerque cop who assaulted videographer on film wants job back


Daniel Guzman was a little over a year out of the police academy when he pounced on a KOB-TV News videographer, arresting him for disobeying a police officer last May.

The incident was completely caught on video, which turned out to be enough evidence to drop the charges against the videographer as well as to terminate Guzman from his $58,000-a-year job.

Now Guzman is asking for his job back, according to KOB-TV investigative reporter Jeremy Jojola, who is also a Photography is Not a Crime reader.

Guzman has even hired a lawyer in his appeal before the Albuquerque personnel board. And if he wins his case, he will receive back pay.

According to Guzman’s lawyer, the officer was simply following orders when he arrested KOB-TV videographer Rick Foley.

“We believe that this termination is absolutely an extreme, unwarranted decision by the city to fire a good police officer who was following instructions from his superiors when he did what he did,” attorney Sam Bregman said.

Jojola has set up a poll on his blog asking readers whether Guzman should get his job back. I voted no, only because there wasn’t a selection that said “hell no”.

He is claiming that he was “only fallowing orders”. I think we have heard this one before. If they buy this it will be expensive having to replace there blue shirts with brown

If he was following orders, then instead of re-hiring him, they should fire the guy who gave the orders.

The Nazi soldiers used the same excuse of “following orders” as they sent Jews to the gas chambers. A soldier or a police officer needs to use common sense, and to disobey orders if they are a violation of the law or violate a persons’ rights.

Even if he thinks he was only following orders, I highly doubt that he was ordered to attack like a rabid dog.

In Marine Corps officer candidate school there was training about the My Lai massacre in Vietnam and the duty of officers to ignore unlawful orders.

I would be interested if he got similar training.

There is no reason to put this bully back into a position of authority over others.
