Another American-born citizen jailed in Arizona because her skin was brown



Even though the controversial Arizona law that allows cops to use skin color as probable cause has not gone into effect, authorities have wasted no time in detaining American-born citizens simply because they looked too Hispanic.

Or as they would say it, because they were not carrying their papers with them at the time, including their birth certificates.

And some people still agree with this law?

Let’s not forget that we live in a country where we don’t even have to identify ourselves unless we are being lawfully detained or at least operating a motor vehicle.

And ever since the civil rights movement, lawful detainment meant that cops needed a little more probable cause than skin color.

The latest incident involves, not surprisingly, Sheriff Joe Arpaio’s deputies who detained an American-born woman while conducting an immigration raid at a McDonald’s.

The woman, who is a manager, is a mother, a wife and is fluent in English.

But her skin was brown, so that obviously gave deputies enough probable cause to detain her for four hours.

About 20 other McDonald’s employees were said to be illegal immigrants, which just goes to prove they are stealing our jobs. At least our minimum wage, part-time jobs that normally go to high school students.

This is what Arpaio had to say about the detainment.

“That’s just normal police work, ” he shrugged in a news conference following the raid.

“Sometimes you do have probable cause, you do take people in for questioning, and they’re released.”

He’s right about one thing. That is just normal police work.

Police abuse probable cause on a daily basis throughout the country when it comes to simple matters as taking photos or shooting videos of cops.

They did it to me twice, even  though there is nothing in the law books to allow them to do so.

But now we’re going to give these cops in Arizona legal permission to shake down citizens at will?

At least one other American-born citizen was jailed in Arizona because he was not carrying his birth certificate.

How bad is it going to get when the law goes into effect?

Pima County Sheriff Clarence Dupnik, who apparently is the anti-Arpaio, said he will refuse to enforce the law because it is “racist” and “disgusting.”

But when you have a guy like Arpaio who has been racially profiling citizens for years, the last thing you want to do is give him a green light to ask for your green card.

What about the OTHER twenty people that were arrested? How many of THEM turned out to be illegal?

It seems to me that this news report is spinning this story in a very weird way. If one out of twenty people arrested during this raid , is a legal citizen, and the rest are illegal, it would seem to me that this was a damn good raid.

95% success is worth a 4 hour detainment for one unlucky person in my opinion.

The company should be penalized, not the manager.

She wasn’t arrested for hiring illegal immigrants (it’s not an arrestable offense). That’s not how justice works.

My plan gets to root of why they come here. First, I would do away with all government funded welfare. Second, I would rid us of the Federal Reserve which created the malinvestment bubbles that drew massive numbers of illegals over the border to work in construction. Third, I would get rid of almost every federal regulatory agency (which kills business). Fourth, I would abolish the Federal Income Tax.

There are other things I would do as well. In short, I would remove every government restriction which holds back free enterprise and prosperity. When we have prosperity, no one gives a rats ass if immigrants clean our toilets and mow our lawns. It’s resentment and envy that turns us against them.

And…if you want to argue that they are somehow polluting our culture, let me say this. There was a time in our country when power was decentralized and devolved down to the local level. Thus, there was great plurality and cultural difference between communities. I am old enough to remember the German communities here in Central Texas. Germans, escaping the European communist revolutions of 1848 flocked to Central Texas and established communities. (actually, they were the Communists) As late as the 1980′s, I represented some of those American-Germans who still spoke with heavy accents and had grandparents who never learned English. There were also similar Czech and other communities around here.

I also grew up in a cotton town in West Texas and went to school with the kids of migrant workers. The Mexican culture has always been present in my life. I’m less concerned with that than I am with the empowering of a bunch of unionized, thug cops to make judgments about who looks like a foreigner and who should be hauled in to jail on that basis.

You keep empowering and encouraging such thugs and they will be after tea partiers next. And, yes, I’m one of those too.

If they never used any government services would you still want them out of “your” country? If so your are a racist. Oklahoma H.B. 1804 (2007) allowed police to check the immigration status of anyone arrested and toughened up the laws against people who employ illegals.

IMO, that is where the enforcement has needed to be the whole time. Republicans are as guilty as Democrats when it comes to enforcing the law against business owners.

There was the same predictable calls for boycotts and blah, blah, blah. Nothing happened. All that is just posturing.

Watch what happens to the marketability of the person who comes out in favor of ignoring our sovereignty by ignoring federal and state laws. Do you hear the Dixie Chicks anymore?

Thank you for highlighting this issue. People lately are mistakenly claiming that the law only requires immigrants to carry papers. As you highlight this is patently false. The law requires anyone, citizen or not, who happens to have brown skin, to carry proof of citizenship. While horridly racist, it’s even more horridly a violation of our basic status as Americans.

I took only one course on that specific period 0f 1916-1927, guys, but I had already read the required reading list of approx. 8 books, and the secondary and tertiary list of 20 more. I got a near perfect 100% throughout the course without cracking a book. I started as a teenager, and carried books on the subject during my military years. I’ve read well over 100 books specifically on the subject, and as many on peripheral. In relative terms, Lenin was the more accommodating/pragmatic or the Kulaks would have died to the child, as Stalin tried to do to the Ukrainians to make them submit to Industrialized Agriculture starting in 29 through 33 something Duranty and the NYT so well denied.

I actually sympathize with you while disagreeing. No, it’s not cognitive dissonance. A lot of good ideas are simply taken too far into corruption. We have always regulated business to some extent, now we over regulate for example.

However, the Federal Reserve has been a stabilizing influence over all, and it was created to do just that. The “Great Depression” wasn’t the first, there’s 1837 and 1893, as well as possibly 1857, 1873, and 1907. I used to live in Tucson back in the 80s. Most of the city police and county sheriff deputies had Spanish last names, so you’re going to have Hispanic officers hassling the “brown” people. It doesn’t make any sense. I’m no lawyer, but as I understand it, if you a resident alien, federal law requires you to keep your green card on you at all times. The whole thing is a mess.

This is about the worst story you could use for being against the AZ law. There are just a few things that some have already pointed out and a few that I don’t think anyone has said.

1. She was not just picked up off the street. It was a raid on a business and being a employee there made her a suspect.

2. Being detained for a few hours during a investigation happens all the time. If it was a drug raid and she was in the house the same thing would have happened.

3. Arpaio already has ability to do immigration enforcement under 287g. So the new AZ law doesn’t affect him and the his department.

4. It is stated in the new law that a certain forms of ID are a valid proof of legal residence, Pg 1 lines 37-43 http://www.azleg.gov/legtext/49leg/2r/bills/sb1070h.pdf

5. Their must first be a legal stop for some other crime, other then immigration, and must find a reasonable suspicion for the LEO to ask about immigration status.

Actually I don’t understand why Police can not under their daily job to check for immigration. Police are tasked with enforcing all laws, even federal laws. So why is this any different. Maybe if they had the ability to do this years ago the problem now wouldn’t be so great.

Jody, This country is based on the rule of law. Those laws are to be applied with out difference to ones race or nationality. At least that is what, I believe, this country strives for. Does that mean that the people that we have entrusted to enforce those laws, at times, will overstep or break those laws, No. Will those that break the trust we have given them always get punished? No. But that is also the reason we have freedom of the press. They are their to, at least try, make those that do break the law get punished. No system is perfect. But from what I get from your post, is because of this, there should be no laws.

As for you comment about being racist. If all you do is look for something that is racist you will find it, real or imagined. You can also just cry racism to shut up those that disagree with you. No one likes having that charge leveled at them. I believe that you are one that uses that charge to shut people up. Only problem with that is it has been used to often and just as the boy who cried wolf , people no longer believe it.

This law is not racist. It actually goes no farther then what the Federal law is. It just gives the local police the power to enforce laws that the Federal government has refused to do.

I’m Arizona State Senator Sylvia Allen. I want to explain SB 1070 which I voted for and was just signed by Governor Jan Brewer.
Rancher Rob Krantz was murdered by the drug cartel on his ranch a month ago. I participated in a senate hearing two weeks ago on the border violence, here is just some of the highlights from those who testified.

The people who live within 60 to 80 miles of the Arizona/Mexico Border have for years been terrorized and have pleaded for help to stop the daily invasion of humans who cross their property . One Rancher testified that 300 to 1200 people a DAY come across his ranch vandalizing his property, stealing his vehicles and property, cutting down his fences, and leaving trash. In the last two years he has found 17 dead bodies and two Koran bibles.

Another rancher testified that daily drugs are brought across his ranch in a military operation. A point man with a machine gun goes in front, 1/2 mile behind are the guards fully armed, 1/2 mile behind them are the drugs, behind the drugs 1/2 mile are more guards. These people are violent and they will kill anyone who gets in the way. This was not the only rancher we heard that day that talked about the drug trains.

One man told of two illegal’s who came upon his property one shot in the back and the other in the arm by the drug runners who had forced them to carry the drugs and then shot them. Daily they listen to gun fire during the night it is not safe to leave his family alone on the ranch and they can’t leave the ranch for fear of nothing being left when they come back.

The border patrol is not on the border. They have set up 60 miles away with check points that do nothing to stop the invasion. They are not allowed to use force in stopping anyone who is entering. They run around chasing them, if they get their hands on them then they can take them back across the border.

Federal prisons have over 35% illegal’s and 20% of Arizona prisons are filled with illegal’s. In the last few years 80% of our law enforcement that have been killed or wounded have been by an illegal.

The majority of people coming now are people we need to be worried about. The ranchers told us that they have seen a change in the people coming they are not just those who are looking for work and a better life.

The Federal Government has refused for years to do anything to help the border states . We have been over run and once they are here we have the burden of funding state services that they use. Education cost have been over a billion dollars. The healthcare cost billions of dollars. Our State is broke, $3.5 billion deficit and we have many serious decisions to make. One is that we do not have the money to care for any who are not here legally. It has to stop.
The border can be secured. We have the technology we have the ability to stop this invasion. We must know who is coming and they must come in an organized manner legally so that we can assimilate them into our population and protect the sovereignty of our country. We are a nation of laws. We have a responsibility to protect our citizens and to protect the integrity of our country and the government which we live under.

I would give amnesty today to many, but here is the problem, we dare not do this until the Border is secure. It will do no good to forgive them because thousands will come behind them and we will be over run to the point that there will no longer be the United States of America but a North American Union of open borders. I ask you what form of government will we live under? How long will it be before we will be just like Mexico, Canada or any of the other Central American or South American countries? We have already lost our language, everything must be printed in Spanish also. We have already lost our history it is no longer taught in our schools. And we have lost our borders.

The leftist media has distorted what SB 1070 will do . It is not going to set up a Nazi Germany. Are you kidding. The ACLU and the leftist courts will do everything to protect those who are here illegally, but it was an effort to try and stop illegal’s from setting up businesses, and employment, and receiving state services and give the ability to local law enforcement when there is probable cause like a traffic stop to determine if they are here legally. Federal law is very clear if you are here on a visa you must have your papers on you at all times. That is the law. In Arizona all you need to show you are a legal citizen is a driver license, MVD identification card, Native American Card, or a Military ID. This is what you need to vote, get a hunting license, etc.. So nothing new has been added to this law. No one is going to be stopped walking down the street etc… The Socialist who are in power in DC are angry because we dare try and do something and that something the Socialist wants us to do is just let them come. They want the “Transformation” to continue.

Maybe it is too late to save America . Maybe we are not worthy of freedom anymore. But as an elected official I must try to do what I can to protect our Constitutional Republic . Living in America is not a right just because you can walk across the border. Being an American is a responsibility and it comes by respecting and upholding the Constitution the law of our land which says what you must do to

Sorry Carlos, but you are being biased on this one. 1 person out of 21 was innocent. She was detained because

A) They had to validate her identity because illegals were using falsified documents
B) She was working with 20 other illegal immigrants. If you are around a bunch of people breaking the law, expect to be hassled some. If I was in a restaurant with a bunch of people, and they were doing something illegal; I would expect to be detained as well.

“All Men are created equal”! The founders had it right, when attempting to form a perfect union and they also knew that they were not there yet but knew we one day would get there. Lincoln moved us forward as did JFK and LBJ. This Nation was founded by men of many nations and backgrounds. The thing you have to remember is that this law is not about stopping people on the street. There has to be an underlying legal reason for the contact in the first place.

In this case the manager of this McDonalds was knowingly hiring illegals. That is a crime and she should have been arrested.

This company obviously hires many illegal aliens knowing they are illegal. It isn’t a big thing since she was the manager at the time and had many illegals working under her when the raid occurred. The owner needs to go to prison and pay big fines. This needs to stop and is the main reason for the 30 million invaders we have here. She needs to stop crying and being a big baby, she didn’t get hurt and has nothing to complain about. Maybe she needs to carry a drivers license or ID on her, everybody does it. Anytime you run into police, the first thing they ask for is your identification so they can run a check on you.

One person gets detained for a couple hours and we caught a busload of illegal invaders. I would call that a 100% complete success. GOOD JOB JOE!

I’m glad you’re acting as a watchdog over the police. Checks and balances play a crucial role in a healthy democracy.

But you’re a journalist, and as such should report the facts. Not just in your own stories, but you also should shed light on distorted facts in other media stories — such as the one you embedded.

This shouldn’t have even been a news story — there’s no news. Innocent people are legally detained every day for questioning and then released. She is brown and she works at a place where dozens of illegal immigrants — from Mexico — were said to be employed.

If the police ever detain me while searching for a suspect who shares my physical characteristics — tall, slim white male, brown hair — it’s all in a days work. If the person the police detain is a minority — it’s racial profiling?

Many people have already brought up valid points as evidence that this story is not racial profiling, nor is it unjust. My post is simply a plea to stick to the facts. Otherwise, next time you cry wolf …

Except that a valid driver’s license did NOT prevent the San Jose trucker from being detained on suspicion of being an illegal alien.
