Austin Man Facing Felony After Photographing Cops Making Arrest
A man who witnessed two Austin police officers manhandling a woman at a gas station pulled out his cell phone to snap a photo, prompting the cops to approach him in a threatening manner.
The cops accused him of interfering with the investigation.
The only thing he was interfering with was the story they planned on conjuring.
Anthonio Buehler, a West Point graduate who served in Iraq, told them he was only exercising his right to take pictures.
One of the cops then pushed him against his truck before taking him down and arresting him, charging him with harassment on a public servant, which is a third-degree felony.
As usual, the cops created their own version of the story, saying Buehler had gotten in their faces, even going as far as spitting at them.
But they didn’t realize another citizen was video recording the altercation from across the street.
And thanks to Craig’s List, Buehler was able to track that witness down.
Now the Austin Police Department is forced to explain itself to the media why there are discrepancies in their version of the story.
According to KVUE:
The officer accused Buehler of spitting in his face. Buehler denies it. Buehler put an ad on Craigslist for anyone who may have witnessed the incident. Someone responded and provided video which appears to support Buehler's version of events.
Austin police disagree.
"Buehler was in the officer's face," said Corp. Anthony Hipolito, an APD spokesman. "The officer kind of put his hand on his shoulder and tried to back him up and at that time was when Buehler spit in the face of Officer Oborski. At that time he was placed under arrest for harassment of a public servant which is a third degree felony."
"I want to see both cops reprimanded, disciplined, maybe even fired," said Buehler. "I saw a woman getting assaulted by the police. It looked like police abuse, and I decided to speak up and take pictures. I think that is every person's right."
Buehler says there was a female who witnessed the altercation and offered to give Buehler's friend her card. Buehler says police prevented her from do so. Buehler says he would like for that woman to come forward as well.

I knew he looked familiar. When they mentioned he was a Ranger and USMA graduate, I knew where I'd seen him before.

As for the Austin PD, their claim here seems to be, "Who you gonna believe? Me, or your lyin' eyes?" The spokesman says "Buehler was in the officer's face", yet he was backed all the way against his truck, leaning backwards, while being shoved and before any effort to take him down.
So the man recording was charged with harassing THEM?? If anything they were the ones harassing him! If the dumb fuckin cop had stayed out of Buehler's business, there wouldn't have been a need for accusations of spitting and whatever else. TO ALL FUCKIN COPS... STAY OUT OF PEOPLE'S DAMN BUSINESS UNLESS THEY ARE BREAKING THE LAW. I'm so tired of these incompetent cops making up the law on the spot.
It's like that man in Vegas who was tackled and arrested in his own damn driveway for videotaping cops responding to a break in at his neighbors place... just no reason for it to have ever happened.. if you are a cop and you feel you are so damn important that you have to be involved in shit to that level, find a new job. These guys are so damn full of themselves.
It's not at all unusual for a bad cop to charge his victims with the crimes the cop committed against them.
If obeying their oath makes the officer's job impossible to do, then there is something deeply wrong with the way that officer does his job.
Is it just me or does the west-pointer look like he could have broken that cop's arm at any moment? He would have been right to do so since the cop was trying to execute an unlawful arrest.
PREDICTION: He gets a date with the tipsy chick the cops were abusing.
It is rarely legal to physically resist an unlawful arrest. That's normally a good way to get yourself legally hurt.
The court route is a good way to go, especially with video on his side.
But on some occasions it is legal. If Anthony thought the photos were going to be destroyed he has a right not to obey the cop's unlawful orders.
I lived in Austin for several years, and knew several officers on the APD
They scare the shit out of me.
Corrupt, corrupt dept, at least it was in the 80's.
I see no reason for it to have changed.
This is horrible! I live in Austin, and I'm going to follow this case very closely to see that the 2 officers are brought to justice! We, Austinites will not stand by and allow this to happen to one of our own, much less one of our hero veterans!
Isn't it interesting that "Johnny Law" has kept silent about this situation and post.
Once again his silence has shown us how he feels and thinks, which is...
"Cops Can Do NO Wrong!"

So by not endorsing this cop's behavior, he's endorsed this cop's behavior?
how bout this. he endorses it by not condemning it
APD spokesman Corp. Anthony Hipolito is a liar. The video clearly shows hes lying. He was sweating during the interview too. Fire the corrupt cops and this APD media spokesman loser....and all those that continue to block truth and justice. If these corrupt government officials aren't held accountable then #1776 is on. We are given no other choice.
I don't suppose one of these cops was Jason Rosson. That liar cost me about $3,000 because he couldn't understand the evidence at a collision which he did not see. I didn't get a dime from the responsible driver, one Arline Redland. I couldn't get anybody to listen to reason down at City Hall. When I showed counselor Espeth the photo of the damage, she first jumped back in her chair then refused to look at it. The city kept changing counsel and arranging hearings in front of different judges. They even tried to dump it on a cute little intern from an Ivy League law school Who offered me a plea. That was just nuts. I finally hired the baddest dope lawyer in West Texas. When we showed up with models and exhibits the prosecution tucked their tail between their legs and ran away. This took aver a year. And in the process the court clerk abused me by passing my request (made with ten days of the accident) that the dashcam tape be sequestered directly to the prosecution without ever going through the judge. Oh, did I forget to mention that Rosson took my attitude of innocence as evidence of guilt? And yes, I do have an attitude. The Austin P.D. worked hard to instill it in me and as we all know they can be very effective when they want to be. I am a Christian And I worked with the Security Police in Vietnam, but it is still a tossup with me as to whether I would help one of them out if I saw him wounded by the side of the road or whether my attitude would manifest as "Let him bleed!" Is this really the kind of citizenship Acevedo wishes to engender?
Are austn cops liars? Rosson certainly is. Do they shoot first and ask questions later? Read the Statesman.
Are they competent law enforcement officers? Hah!
Are Austin cops liars? see Operation Malasangre. Vitray certainly knows but just an exercise for all to see the level of corruption in that city.
I took a look at the video and it seemed to me that the cops were attempting to bend this woman into the classic strappado position used as torture at least since the days of the roman empire. If I had done this as an airman I would have been a criminal in violation of the articles of war.
There is a book out called 'Are There Christian Cops in Austin Texas' that detail the rise of the 'occupied' form of policing that APD is using. Sold on Amazon.com, the download is going on sale in a few days for $2.99, while the book sells for $15.00. This is an oversight of APD history, some of the questionable events and the underlying root of facism and discrimination. It also tells the story of a remarkable police officer who refused to taser just for the sake of tasering and who is now a police officer in another city and a ordained minister.
The book also sells at Brave New Books, in the basement of Chase at MLK and Guadlupe for $10.00, which sells some of the most interesting books of today.
