Bailiff calls reporter "asshole" in New Mexico courthouse


Jeremy Jojola, an investigative reporter from KOB-TV in New Mexico and a regular reader of Photography is Not a Crime, was arguing his right to videotape in the hallway of a courthouse this week when a bailiff called him “an asshole.”

He should be proud.

After all, I’m an asshole. This guy claims to be an asshole. And now Jojola has been called an asshole.

All because we stand up for our Constitutional rights.

The incident started when the bailiff ordered a group of journalists into a conference room, segregating them from the general public and ordering them not to shoot video in the hallway.

Jojola began complaining, which ruffled the bailiff.

Jojola turned on his camera and began recording audio. The bailiff calls him an asshole at :40 and admits to segregating the reporters at 1:15.

As Jojola explains on his blog, the incident was more amusing than insulting and they eventually worked things out civilly.

No big deal. I do find it amusing and I’d figure you may too since many readers of my blog like the behind the scenes stuff.

To give the bailiff credit, he became more reasonable and actually seemed like a nice guy after the whole exchange.

I could only imagine what would have happened if I resorted to the same vulgarity.

I’ve mentioned Jojola on this blog before, including the time he won an Emmy back in 2008.

Jeremy Jojola, right, asks former State Senate Pro Tem Manny Aragon if he wanted to apologize to the people of New Mexico for stealing more than $600,000 from taxpayers. Aragon, known as the "Godfather of Corruption," had just been sentenced to five years in prison. He never answered Jojola's question.

He didn’t call him an asshole. He said ‘if you want to be an asshole about it.’ Jeremy never replied as to whether he wanted to be an asshole or not. Bailiffs are charged with a duty to keep situations under control. The guy was just doing his job. Media has to have prior permission in order to video tape in a courtroom, pursuant to court rules. If the bailiff were an asshole, he would have simply gone in and told the judge that a reporter was backtalking the bailiff(s) and the judge could have banned the media. The media is way too pushy and should show more respect than they do in court houses and court rooms.

Within three minutes of “Chickadee’s” comment, I received a direct message from a defense attorney by the name of Sarah Montoya with the same tone and message.

So I have a strong assumption it’s her. She represented Wayne Bent (who’s locked up for touching a teenage church member).

Sarah doesn’t like the media and often complained about them during that trial, which I covered. So I’m not surprised at her perspective here and….her supposed grudge against the press.

I’m just trying to do my job too….and that includes aggressively defending my right to shoot where the law permits me to shoot.

If I’m rude too, oh well.

Officers of the court should respect the First Amendment if they don’t want a rude and push press.

This is a pervasive problem everywhere in the local legal industry, from the UNM Law School right up to the Chief Judges and Justices in the Supreme Court (I have cites for every claim I make.), and the Judicial Standards Commission itself. There appears to be a sense of entitlement and invincibility far beyond the other two Branches of Government–If that could be possible. These folks are in desparate need of a rude awakening.

In the first place, It is the media’s job to push for the truth. Of course this will not set well with those who do not want the truth , but only there own view, reported. I would rather have one “ass hole” like Mr. Jojola than any number brown noses like this guard and attorney. All I can say is Mr. Jojola struck home.

Jeremy, I do not hold a grudge against the press. If you had any sense you would have pushed for the truth in the Bent trial, which you did not. You could have asked to speak with me, but you never did. You missed the boat there. I think you’re doing a great job incorporating the media into your work. That is why I follow you. But your perceptions about me are WAY off. Just like you were WAY OFF above. Don’t involve me in your attacks. I’m out of the picture now and am not interested in being fodder for your search to make a story where none exists. Good luck in your search for the truth, but I agree with the earlier post, you were being rude, and there’s an old saying that “you can catch more flies with honey than vinegar.” But I see from your post above that there’s no honey in your attitude, particularly for me. I don’t know why. Too bad. Your loss. I WAS an admirer. But you are dangerous. You jump to conclusions too quickly.

He didn’t call him an asshole, he said he was acting like an asshole. Big difference. This is exactly why wannbe reporters like you can never be taken serious. You have the tape of what the person said right in front of you, and you still can’t get it right. You really should try a career change or find a way to do this one right. I mean, seriously, this isn’t exactly the hardest job in the world. People say stuff, you right it down. Not exactly rocket science… but it still seems a little out of you mental realm.
