N.C. Blogger Threatened With Arrest For Photographing Arrest

A North Carolina blogger was threatened with arrest Thursday after attempting to photograph a cop making an arrest.

When the blogger demanded the cop’s name, he lied and provided the name of a fellow cop.

The woman who runs Crime in Charlotte then called the public information officer, who informed her that the First Amendment did not apply in Charlotte.

According to a North Carolina blog called Cedar Posts and Barbwire Fences:

When Crime In Charlotte requested the officer's name he told her that his name was Williams. Turns out he forgot that his name was M. Thompson and that the other officer's name was Williams.

When Crime In Charlotte called CMPD's Public Information Officer Rosalyn Harrington to discuss what happened, Harrington was unapologetic saying that officers were within in their rights to arrest Crime In Charlotte. When Harrington was pressed on the validity of the law she stated that Charlotte had rules that are different from other cities like Baltimore, as she continued to explain away the officers actions as justifiable.

A casual glance through Crime in Charlotte reveals a very police-friendly blog praising June’s Officers of the Month and reminding readers to “Commend a CMPD officer! while filling in the rest with the usual police blotter.

She was even the one who dialed 911 to report the felon that police arrested on an outstanding warrant Thursday morning, the one she tried to photograph.

Now the blogger is so distraught that she not only won’t write about the incident, but believes it’s “time to take a break” from blogging.

So maybe she wasn’t cut out for it in the first place.

Or maybe she should just come to the dark side and start shining a critical light on the Charlotte-Mecklenburg Police Department.

UPDATE: Not all CMPD cops threaten to arrest citizens when they are being videotaped or photographed. An alert PINAC reader sent me the video below that shows a group of young, black men walking around downtown Charlotte with a video camera when they come across a group of cops making an arrest and searching somebody's car.

Rather than start threatening the men with arrest, one of the cops pulls out his own video camera and starts filming them.

I guess the real light finally broke through her rose colored glasses. Sad for her I remember when my eyes were finally opened too, but luckily for me it happened when I was younger.

Hmmm I wonder what all the "Oh if you're nice and do what you're told you won't have any problems as police will reciprocate in kind." folks will have to say about this?

I am talking now... Even posted a pic of myself where the incident occurred. :) I'm seriously considering going to the 'dark side'... but I have to be honest and say Cedar Posts cannot be outdone and truly has that covered in this city. I will figure something out.

Just like myself, I have been a huge supporter of law enforcement. I have a few family members in law enforcement, I was a dispatcher for my local PD, and I have many friends that are deputies and officers to this day.

However, when my career changed from dispatcher to photojournalist, I encountered a totally different side of the job. The first day I was screwed with was the day my world changed.

It's hard to keep in prospective that there are many good cops out there, but way too many of them are too inclined to mess with photographers.

Even though you won't make friends standing up for yourself, it needs to be done every time you are screwed with. The next generation of photographers will thank you.

When you say there are "many good cops", where are these cops to at least reprimand the bad ones? They are NON EXISTENT.

You need to amend your statement. There are many normal apathetic cops who just do their basic job but do nothing to try and uphold the constitution. That is not an honorable thing to do. Their defense of their brothers in blue allow a system of corruption to continue to thrive.

If you have a good cop and a bad cop, and the good cop witnesses the bad cop committing crimes, and takes no action (or takes different action than they would upon seeing a non-cop committing the same crimes), then you have two bad cops.

I really think you should make an issue about the cop misidentifying himself.

Maybe you can request his personnel file to see if he has any previous complaints about that.

I did report this and had even called my friend to the scene (I was SCARED!) so I even have a witness. I was told by CMPD Sgt. Reiner (Ind Div) that I must have 'misunderstood' the Officer. I DID not misunderstand ANYTHING as those names were VERY important to me. My friend did not misunderstand what he heard either.

I was given one name... J. Williams (who does not exist) He told me HE was the one who threatened me, when asked for the other Officer's name. I needed both names because I did not know which one or maybe both threatened me as I was so far away.

I do know the face of the Officer who stayed and spoke with me after the suspect was taken to jail, who identified himself as "J. Williams. According to Sgt. Reiner, he was in fact M. Thompson. I still DO NOT BELIEVE it and requested to do a 'line up' and my friend is willing as well but my request was denied by Sgt. Reiner.

I identified myself to this Officer as Kelly X, the blogger @ CrimeInCharlotte and he said he had heard of my site so HE KNEW I was media, he KNEW and SAW with his own two eyes that I was seriously shaking in fear. CMPD protocol demands he should have called his Sgt to the scene but did not... WHY??? Clearly, something is VERY FISHY here but CMPD refuses to see it and his Sgt is covering for him too. How am I supposed to continue to support this corrupt police Dept? I can't!

What would be the reason for calling his supervisor to the scene? Just curious.

Hi Johnny Law, It seems to me that if he wants to arrest you for something that is not a crime, it's reasonable to have a Sgt on-site. In addition, it's telling to me that this officer didn't want his boss around because truth was not forth coming from his lips. Would you agree that it's wrong to lie to the general public about who you are while on official police business (not undercover) and wrong to threaten to arrest someone for a non-crime? Just curious...

I won't Phred! The fact the Dept. is ignoring what happened shows me it is time someone stood up to them. Clearly, this behavior is acceptable to them and that does not fly in this house. Thanks for the support!

This won't end until cops start losing their homes and other assets and have to explain to their families why they're being shunned. And by "shunned" I mean no one, not even the utilities, are willing to do business with them.

I just updated the story with a new video of a group of CMPD cops reacting to a group of black men videotaping them in public.

Charlotte's local newspaper 'The Charlotte Observer' picked up the story & mentions several problems involving police and photographers in Miami as well as other Nat'l issues regarding police -vs- photographers.
