Boynton Beach Cops Once Again Use Wiretapping Charges On Citizen Recording Them

Boynton Beach police are once again using wiretapping charges to crack down against citizens who record them in public.

Two years ago, the South Florida police department arrested Tasha Ford whose charges were quickly dropped.

Last night, they arrested Joshua Mandel who was recording police on his iPhone, chanting "First Amendment" over and over again, according to a news report.

Investigators said this caused a substantial crowd to surround the officer, and the entire shift of on-duty officers responded to the scene on West Gateway Boulevard

The entire shift of on-duty officers? Was it that slow of a night?

Mandel was charged with disorderly intoxication, resisting arrest and illegal interception of comunication.

Ford has a pending lawsuit against the police department for her unlawful arrest.

Hopefully, Mandel will do the same because even if he was drunk, police had no grounds to arrest him on the wiretapping charges.

That way he can't use the video

How "STUPID" does a Boynton Beach Cop (or any Cop for that matter), have to be to not realize taking pictures of them isn't against the law.. especially considering the fact (in this case), their dept recently had a pending lawsuit placed against them?

With as many dropped charges (and lawsuits that have occurred against various Police depts. nationwide), I can't believe most Police dept. brass hasn't sat the troops down and read them the riot act, ie:

"The next one of you jokers who tries to arrest someone in the public legally taking you picture is going to get three days off WITHOUT pay and then for the next 6 months you're going to be walking your beat in the middle of the garbage dump!!"

I mean, come on.. as a Cop if you don't know by now that "Photography's Not A Crime" then you have no right carrying a shield (and the limited authority that goes along with it).

When people wake up and realize that half of their property tax increase is going to pay off the victims of their blue-shirted brute squad, then it will end.

We're told over and over by police, courts and TV that ignorance of the law does not excuse a lawbreaker. This truth is borne out by the fact that claiming ignorance of the law in court usually gets you less lenience than pleading guilty and showing remorse.

Police are supposed to be highly trained professionals, and part of their training is to know the law they are supposed to be enforcing, that they are sworn to uphold.

So WHY do we excuse ignorant police officers? Why is it considered "crazy talk" when people expect officers to at least possess the minimum knowledge of the law expected of an ordinary citizen? A citizen who misunderstands a law and breaks it non-violently goes to jail; A cop who does the same and commits violent acts might not even get an unpaid vacation!

If you're not cop, you're little people.

Sounds like it was the incitement of the crowd and not the video that caused the arrest.

Sounds like the crowd wouldn't have been "incited" had the cops kept their dicks zipped up.

Incitement from the crowd should not lead cops to break the law.

You guys are missing the intent. Multiple arrests build a "criminal record", regardless of conviction. Arrest records do not go away! If the charges are dropped or court records expunged the arrest records are still there! Job application background checks see the arrest records as well as other law enforcement records. You think you can get a job teaching with 10-20 arrests? Even if there were no convictions the arrests will do you in. The cops may be wrong but they get you in the end.

I am Joshua Mandel. I live in Boynton Beach Florida and go to school in Orlando. I am studying communications, specifically to be a reporter and report on this kind of injustice. I am not concerned with the arrest record i am concerned with the fact that people would rather tell me to lay down and not have filmed rather than admit that these officers are way out of line. yes, i was intoxicated, it happens. However, there was no reason to arrest me. I was not two feet away more like twenty. Furthermore, how can i record audio in a noisy bar with a live band? Finally, he was off duty which means he is no more a person than i am. so let me ask a question, what if i was recording a not cop? would they have been able to charge me with wiretapping? no. absolutely no. something must be done and more people need to stand up for their rights as well as the rights of others. just to add to this to try and answer some questions, it was def not the incitement. i was in cuffs and being taken to a car when i started yelling first amendment. there was actually a fight happening when i was filming and the officers totally ignored the fight so that way they could arrest me. thanks for your time guys. i dont go on here often but i will try and check back to maybe answer some more questions.
