Cop's attorney grasping for straws in bike-shoving trial


You would think that the case of the New York City police officer assaulting a bicyclist during a Critical Mass ride would be an open-and-shut case because of the overwhelming evidence against him on the video.

In fact, another video emerged during the trial against former NYPD cop Patrick Pogan that makes him look like even more of a thug.

However, his attorney is arguing that cyclist Christopher Long had it coming to him because he is an admitted pot smoker.

Yep, they’re grasping at straws here.

Pogan’s attorney is trying to convince the jury that Long was probably stoned at the time, so he became very aggressive and tried to hit Pogan with his bike on purpose.

Yes, we all know marijuana turns us into overly aggressive drivers.

The truth is, it looks like Pogan should try a hit of the weed to mellow him out because he obviously has some violent tendencies, not to mention trouble telling the truth.

The rookie cop ended up writing in his report that Long tried to ride his bike into him, which is why he had to body-check him into the sidewalk.

Pogan, who resigned to avoid being fired, is facing four years in prison on charges of assault and falsifying reports.

Pogan’s attorney is also trying to paint Long as being “anti-cop,” which is the same thing they tried to paint me as during my first trial.

But can they really expect someone who has been falsely arrested to be “pro-cop” … whatever that means?

For my money Pogan’s supervisor should take a big portion of the blame. Fer chrissake the guy had been on the force for 11 days and his supervisor tell him to “do what it takes” to cite the bicyclists.

Evidently this bicycling event is a monthly thing that IS causing problems for traffic in NYC but the NYPD’s approach to the problem is manifestly WRONG! The police chief and perhaps the mayor need to sit down with the leaders of the event and see if some agreements can be ironed out that solve the traffic safety issues.

What really gets me about this is that there were so many cameras present. You can see the cameras in the video.

I’m sure there are plenty of other videos out there of the same incident.

Yet these cops didn’t think twice about assaulting somebody and falsifying the report?

This cop needs to go to prison to really send out a message.

I disagree Carlos. What REALLY sends out a message is when the city gets slammed for MILLIONS of dollars in punative damages. Then, and only then, will they start to get serious about weeding out the bad apples from their PD’s. They’ll also get serious about properly training police recruits so this kind of thing starts to fade into the distant past.

The city paid millions in abuse cases like the Abner Loiuma, the cops were sent up the river for life sentences. Nothing changed. Cops are completely immune here. Even if this cop goes to jail for the rest of his life, nothing will change.

The only thing that will make a difference is if the RATE of cops being caught and punished increases. It’s nothing if a one-off cop or two is punished. But if cop after cop after cop is punished, almost on a daily basis, then that will make a difference.

The one tool that makes that difference a possibility is the camera.

The expanded use of cameras is great. But to take things to the proper level, copies of the recordings like this need to be sent immediately to an agency that can initiate an investigation. It is essential to keep any knowledge of the submission from the involved department. Blindside their asses.

If this problem isn’t put into check there will be a time when a police officer’s character and safety won’t be worth squat. It shouldn’t be that way.

I’m with you straw buyer, I’ve always believed anybody accused of a serious crime deserved COMPETENT legal counsel. Many years ago my father was accused of a sex crime and could not afford an attorney so the court appointed him one, a TAX lawyer!! That’s always sorta stuck in my craw.

It always makes me giggle a bit when I hear cops saying that they they were provoked. You would think they would learn by now, with all the lawsuits filed over the last 2 decades, that contempt of cop isn’t a crime.

Just to set the record straight. ONE cop got 30 years. The cop that helped him only got 5 years and has been out of prison since 2007. Three other cops that were found guilty of covering up the crime were completely exonerated by an Appeals Court judge that said there wasn’t enough evidence for a reasonable jury to convict.

the defense attorney’s job is to fool the jury. the prosecution’s job is to make sure the jury, although dumb as a hat, doesn’t fall for it.

The only thing that can ruin this case is if the arrest report, video, and witnesses weren’t allowed to be seen/heard/shown/etc.

You can’t have it both ways. If a fellow cop is doing something wrong, he’s doing something wrong.. and the fact that you keep quiet and not say anything makes you just a guilty as they are.

Some of the fairy tales made up by prosecuters have nothing to do with reality but are merely mechanisms to fool the jury. Prosecuters and defense attorneys can both walk on either side of the street.

I’ll have to admit here that almost all of my life I’ve lived in small towns or relatively small cities. If I’d spent my life in Chicago, New York, or New Orleans I’m sure my attitude would be a lot more negative in this regard.

You’re over-generalizing quite a bit here. I would much rather take my chances with a jury, than with a biased judge. Someday you might serve jury duty, where you may need to make a tough determination of guilt/innocence. You wouldn’t call yourself “dumb as a hat” would you?

Cops are authoritarian fascist pigs that believe they are above the law. Police Officers do their duty to uphold the law, while serving and protecting the citizens of their community.

We are hearing more about cops harassing bicyclists. NYPD stole hundreds of bikes because they deemed them a threat to Obama driving by. There is nothing in our miserable lives as americans that the government won’t control and restrict. It’s disheartening that hundreds of thousands of men and women take up the job of performing those restrictions. Even more disappointing that millions more support them.
