Flashing teenage breasts could land man in prison

A Florida man is facing five years in prison because he photographed two teenage girls flashing their breasts on the side of the road.

Robert Lee Blevins

Turns out, the girls were 15-years-old, according to the Sarasota Herald-Tribune.

It is not clear if Robert Lee Blevins, 33, was aware of their age when he pulled his car up alongside them and snapped a photo.

Nevertheless, he is now facing a felony charge of possession of photos of sexual performance by a child as well as a misdemeanor charge of contributing to the delinquency of a minor.

The girls were charged with indecent exposure and released to their parents.

The girls had been flashing their breasts at all passing motorists, including Charlotte County Sheriff Bill Cameron, who happened to drive by in an unmarked car.

Cameron turned his car around and spotted Blevins pull up alongside them and snap a photo with his cell phone.

Cameron detained all three of them and confiscated Blevins’ cell phone.

Something tells me there are probably many more images of these girls’ breasts floating out there somewhere.

15? Old enough to bleed, old enough to breed I say.

Shoulda got a hell of alot more than just a picture if you’re goin to jail! Ha.

Can’t even express how much it sucks to be the dude who took that picture. His life is now ruined because he took a picture of a couple of teenagers being idiots in public. He didn’t try to distribute it, didn’t know who the girls were or how old they were, just snapped a picture and now will probably have to go door to door introducing himself whenever he moves. Sad.

Why is it that it is OK for Hollywood to file topless girls under 18 and make millions, yet the average person gets thrown in jail?

Examples:
Jessica Biel was 17 when she posted somewhat topless and wearing a thong for the 1st issue of Gear magazine (not defunct).

Thora Birch was either 16 or 17 when she was filmed/photographed topless in the film American Beauty, which WON FIVE OSCARS!!

My guess is that there is a video rental store in Charlotte County, so I wonder if the owners/employees have been arrested if they offer for rent a copy of American Beauty?

Clearly the guy should have asked for the girls’ ID before he started shooting. Sheesh.

Oh gods that sucks so much for this guy.

You’re right, his life -is- ruined, completely and utterly till the day he dies because of a moment of human cheekiness. Maybe he shouldn’t have stopped to take the photo, but…

I’ve stopped on the side of the road to take pictures of many interesting things from accidents to a drunk guy with a stuffed skunk … Oh dear, I have a picture of a flasher on a subway platform. Good god I hope she was 18+.

No sense of perspective in that cop, none what so ever. Or decency, I love how the press release jokes about not being able to give the picture to the media but the article has no comment about how this mans life is ruined because he chose to take a picture of boobs.

I think this says more about Charlotte County Sheriff Bill Cameron’s mind than Robert Lee Blevins.

Be careful out there. Even ASCII art of teenage breasts such as this (o) (o) can land you in the big house.

If that goes through, then I will have the perfect refutation for all the “hang all the sex offenders” crowd.

Snap one picture = death penalty.

I know it’s too much to ask for but it would good if the prosecutor was reasonable and realized that there was no intent present.

But that’s not likely to happen and this guy will end up on a sex offender’s list somewhere.

This seems like it could have been easily resolved through police discretion.

“Sir, the girl who you photographed topless is 15 years old. Please delete the images, or I will be forced to confiscate your cell phone and place you under arrest.”

“I had no idea officer. I’ll delete the images now.”

Simple solution without ruining the life of some schmuck while protecting the girls at the same time.

This is not completely related but the following article has to do with what you are legally entitled to do with photos you have already taken:

http://www.scpr.org/news/2010/08/05/judge-bars-la-times-publishing-photos/

In this case, a judge’s absolute power over his courtroom conflicts with the first amendment right of a journalist. Who wins? What would have happened if the photo he took was of the jury?

@ Al V

I’m sure there are already countless examples of similar situations that you can use.

The next logical step is for LEO or anyone else who doesn’t want to be photographed to have a few 15 year old girls to hang around them while topless (the girls, not the LEO).

Instant photography-free zone.

The supreme court has ruled over and over again that nudity in itself is not pornography or obscene. This man needs a good lawyer. If he took pictures of my daughter however he would need a good undertaker and a closed coffin.

this reminds me of the story about the landscaper who took a piss after cutting the grass at at home that abutted an elementary school…he did not know this as there was a wall separating the two…a cop saw him tinkle…arrested him…and when the address came up next to a school…he became and was tagged a sexual predator…pretty fucked up…cops need to be less stupid

@jonathan doe Because those were movies and magazines, ie: artistic in nature, not sexual in nature.

I agree with Rich, he needs a good attorney.

@Rich If your daughter goes around showing her chest to everyone, you could probably expect her to have a few pictures taken, though I fully get where you’re coming from.

This is a clear case of sex discrimination. I am sure there are millions of pictures of underage boys without their shirts on, but for girls its illegal? That man did not effect the lives of those girls in the least bit until the officer got involved.

Anonymous

Oh man I don’t know where to start. There are so many more issues here than just the right to take photographs in public. I guess I stand by that principal that photography in public should be allowed. Was he shooting up skirt pictures. No. Was in hiding in the bathroom. No.

This is could be compared to white supremacy free speech – I don’t like it one bit at all but by god I’ll defend their right to do it.

Now I don’t really blame the guy at all. I do have to ask what was the cop thinking? Why do they do stuff like that? Did the guy show contempt of cop and the cop decided to try and ruin his life? Cops seem like they just don’t think anymore. Well, I guess the cop put his life on line for us all so we should be thankful, right johnny don’t know the law?

I agree that if it had been my niece (no daughter) the next shot the camera took would have probably looked like a colonoscopy. That, however, doesn’t make it illegal at least by definition.

Release the pics, let the stupid teenies suffer and learn from their brain dead actions, as well as their brain dead parents. This will provide examples to other stupid parent and their brain dead teenagers.

If your old enough to have tits and flash em in public, then you get looked at, video taped, and photographed.

Now is that really so hard to understand america?

@Rich: Your logic there is part of the problem. If your daughter’s standing around flashing her breasts to passing motorists, the problem isn’t some guy who takes a photo of her, it’s _YOUR DAUGHTER_. Instead of going after him, you should be punishing her to make sure she knows what is and isn’t acceptable. But instead, you, and most parents, just have this knee-jerk “think of the children” reaction and destroy the lives of people who did little wrong because you can’t face the fact that your precious little girl was an idiot.

I have no respect for parents who act that way. Kids do stupid things, they should be taught what was right and wrong, but innocent people shouldn’t pay the price because your offspring was doing something stupid they shouldn’t have been doing. To me if _anyone_ should have been charged here it was the girls, with public indecency.

If it was my daughter she’d have been grounded until she was 30, but I wouldn’t support the charges against this guy. It would have been HER fault, not his.

Legal costs to the county should be charged to the parents not the tax payers, especially since the hundreds of thousands of tax payers dollars wasted on education for these stupid brain dead little sluts obviously did no good for them or anyone else.

I agree with you. The problem lies with the parents who think their child “Can Do NO Wrong”.. and does nothing to correct the ongoing attitude and problem.

This is incredibly disturbing….I am so tired of cops using laws in ways they’re not intended to try to enforce some bullshit personal morality code.

So when the police cars came, did they record the tits on their dashcam? Are the police being charged? If he can be charged with a FELONY for this, then why aren’t all of the people who drove by and saw this being charged with crimes, simply for looking?

What about the DUMB FUCKING WHORES who exposed themselves? They are the ones committing the real crime. Taking photos in a public place should NEVER BE ILLEGAL. These stupid whores need to be charged with indecent exposure and the man’s photo should be used as evidence AGAINST these whores in court. Maybe they’ll think twice about being such dirty, filthy whores in the future.

That’s the problem with our country, NOTHING IS EVER THE CHILD’S FAULT OR THE PARENTS, it’s someone else’s fault. An example, they took away flavored cigarettes here in FL because they were “advertised” towards children? No, they were flavored because I, a 21 year old adult, love their funky and offbeat tastes. But of course I have to suffer because mommies and daddies cannot play a role in their damn kids’ lives, and take two seconds to notice they reek of cigarettes. Obviously smoking is bad, but the point is it’s my choice, I am an adult and I shouldn’t have to give up items of the “adult” nature because parents today are morons. And advertising towards children? Every other commercial on the popular cable stations is promoting a dangerous, addictive and toxic chemical product known as ALCOHOL! “Try our berry blast” “Bacardi Blah Blah Blah”. I mean seriously what the hell is wrong with our society? I am truly scared for the future. One thing’s for sure if my child does something it is either his fault for being an idiot or making a bad decision, or it’s my fault for being oblivious to the situation… Not my neighbor’s, not my enemy’s, but mine or his…

this is kind of stupid, what if, for example a CCTV camera caught some underage nudity. would the company who own it get in trouble?

or you took a picture at the beach and a girl nipple slipped in the background. Is that child porn?

I just think we’re doing more harm than anything by encouraging the thinking that all nudity = sex.

A drug dealer, flying a huge load of drugs in from South America on a private plane, gets wind that the FBI is waiting for him at the airport when he arrives. He decides to just dump the drugs in mid-flight.

Joe Schmoe is walking down the street in his neighborhood when the drugs land on him. A LEO witnesses the incident and calls for an ambulance.

Joe wakes up in the hospital to the LEO reading his rights as he is being arrested for drug possession and trafficking.

This makes about as much sense as the above story.

I think a distinction needs to be made here. He did not get arrested for taking the pictures. He was in public and broke no laws in doing so. He got arrested for having the pictures. The laws are written in such a way that any possession of child pornography is a crime. His mistake was to submit to a search by the police officer. He should have refused the search of his phone and asked for a warrant. All too often, crime suspects are complicit with police officers who don’t have their best interests in mind. Unless ordered to by a court, never speak to the police for your own protection.

Anonymous
Anonymous

Also, never take pictures of naked people unless you are sure of their age. You may not be breaking any privacy laws by doing it in public, but it is a crime to exploit children (even in public).

Anonymous

How can you dedend what this guy did. If you see a 15 year old girl with no shirt and your first thought is to stop and take a picture then you have problems. You can’t have nudey shots of underage girls, the law is pretty black and white. You people cry about cops making up laws and now your crying about them enforcing real laws, you people are silly.

I like the comment that complains that you can get arrested in florida for shoplifting.

from wiki. she was 16 but her parents signed consent and she had a child labor rep onsite during filming

American Beauty – Ghost World

Later in 1999, Birch won enormous critical praise playing the role of Jane Burnham in American Beauty and was nominated for a British Academy of Film and Television Arts award. The movie itself went on to win the Academy Award for Best Picture. As Birch was 16 at the time she made the film, and thus classified as a minor in the United States, her parents had to approve her brief topless scene in the movie. They and child labor representatives were on the set for the shooting of it.

for those of you castrating and hanging this guy. many of you have checked out girls you had no idea how old they were. granted you may not have taken pictures but you have checked them out. sorry but its human nature. get over yourselves. what this guy did was what the majority of us would have done. when i say majority i mean those who are straight both in the closet as well as outside of the closet.

No victim, no harm, no crime?
Unless those teen girls are flashing their titties in public. Then apparently EVERYBODY’S a criminal.

What’s next, will they arrest my daughter for kiddy porn because she took off her diaper and ran across the yard?

All that tells me is some cop or prosecutor took one look at that and got so hard it had to be illegal.

Anonymous

@oscar finch // Aug 6, 2010 at 11:38 AM

I can defend him because the image he took isn’t illegal. The law states that child pornography is far more than just nudity. It has to include lascivious sexual conduct (simulated or real) to be pornography.

Look at the work of photographer Sally Mann. She isn’t on the SO registry. She did the same thing…well…except she mass produced the images and sold them as coffee table books.

This isn’t law enforcement. This is enforcement of popular opinion that is bred out of misconception.

Following your logic every parent since cameras were common in the household would be a pedo because almost all of them have a photo of their child in the tub. Gonna turn in your mother now? After all she’s a vicious predator and not to be trusted. You a parent? Have any nude baby photos? Gonna turn yourself in?

@Bob // Aug 6, 2010 at 10:37 AM

He had nothing to do with their behavior. Thus he wasn’t exploiting them in any way. Their behavior wasn’t a result of his presence or influence.

If anyone should get in trouble it should be the girls….and I don’t even think they should get in major trouble. Anyone else remember their teen years? I remember mine…and I did dumb shit.
