Ft. Lauderdale cop arrests man for asking for his badge number

And in today’s daily contempt-of-cop story, Ft. Lauderdale Police Officer Jeff Overcash did not appreciate a man asking him for his badge number, so he pulled out his handcuffs and arrested him.

And it was all caught on video.

The video shows Brennan Hamilton walking up to Overcash in a calm manner with a pen and notepad in his hand. Overcash, who is leaning against his squad car with other cops, then pulls out his handcuffs and arrests Hamilton.

Overcash charged him with resisting arrest without violence and disorderly intoxication.

For me, it’s like deja vu all over again.

In my second arrest, I had walked up to Miami Beach Police Officer David Socarras and asked for his name and badge number after he had ordered me to delete the photo I had taken of him.

One of his cohorts immediately handcuffed me and Socarras placed me in the back of his car.

Socarras initially charged me with disorderly intoxication but the state attorney’s office changed it to resisting arrest without violence.

The case was dismissed after Socarras failed to show up to trial on two occasions.

The above video was posted on the Broward-Palm Beach New Times and JAAblog.

Hamiltons’s attorney, Brad Cohen, stated the following on the latter blog:

“We have several witnesses for the incident prior to the arrest. The facts are essentially the train was going past the intersection, on SW 2nd Avenue, Fort Lauderdale. My client, Brennen Hamilton, was waiting with his wife and friends for the train to pass. My client leaned up against the rear of the police car.

Officer Overcash approached my client and took him by the arm and said ‘Get your ass off the car. How would you like it if I leaned my ass on your car?’ My client remained silent and rolled his eyes. The Officer said ‘Really tough guy, you have something to say to me?’ My client remained silent.

Officer Overcash then said ‘Yeah, that’s right tough guy, you’ve got nothing to say.’ The train passed and my client and his wife went to his car and called Fort Lauderdale Police, to complain about the treatment he just received. There wasn’t a Lt. or a Sgt. working at that time, so he left his number. During the call he was asked for the Officer’s name and badge number. He did not know that information.

After getting off the phone he went back to Officer Overcash and asked him if he could please give him his badge number and name. That is where the video is recorded. You can see my client approach calmly and request his badge and name. Without hesitation Officer Overcash immediately puts my client in cuffs, and ultimately charges him with resisting without violence and disorderly intoxication. My client was not intoxicated whatsoever. He is a licensed recovery agent and possesses all of the proper State licenses.

We called Internal Affairs today and left a message at 1pm, no call back as of yet. I am preparing my notice of investigation pursuant to Florida Statute and calling SAO Case Filing tomorrow to discuss the charges … “

I hope the cop was wired.

Cops like that need a little card to hand out to people that reads, “I am a police officer. I have a gun. I have a badge. I have a uniform. I have a police car with a big insignia on the door and lights on the roof. I’m king shit. You ain’t nobody, get used to it.”

Lot of courage to make that video. Glad the gal doing it did not get arrested herself. Kudos to her and to B Hamilton for daring to video.

The incident reads almost as if it came from the script I’ve been suggesting. Make a living from a system as a means to bring about system change. It will take a while, perhaps years, but Hamilton will make some money from this incident.

All filth should be required to wear a headcam with HD picture and sound that streams live to the web, after all, if they are doing nothing wrong then they have nothing to hide. What I really want to see is a member of the filth with a headcam who goes and tells someone to stop filming/taking pictures, if that happened it would just help me cement my opinions of these fucktards.

Perhaps Judge Fernandez can help fairly and impartially adjudicate this matter. I hear he has experience in such things.

Also, thank god for the video!!!!

Yeah, it probably prevented that poor cop from being viciously attacked!!

What arrogance. How do I install a camera system in my car?

On a side note Carlos, I saw a comment from Craig Newmark (creator of Craigslist) that I think applies to you.

I come here for stuff I don’t see anywhere else and am never disappointed. You’re the man.

Thers a number of vidio systems for autos, one comes to mind that had 3 or 4 cameras and covered all angles, in and out of the car, that was about $1000.oo. I do not have a site for them, you might Google it.

This is an old article from 2006, but it highlights the abuse of the bogus “resisting without arrest” charge.

I had just seen this on The Injustice News Feed in my RSS reader and then I scrolled down and it’s here too. I figured it would be since it happened in your own back yard.

Arresting someone for asking for a badge number is just stupid. The cop needs to spend a night in jail and then be fired.

Anyone with common sense can see there was NO resisting arrest. He was dumbfounded but not resisting.

I love how cops still choose to do stoopid things when they know they are being taped.

Well, I would have loved for the officer to explain trespassing… The Officers have no right to private property either unless investigating the suspicion of a crime or immediate cause for safety of life or property. Great video and a keeper. An officer IN uniform is NOT a private citizen and should not be offended to produce ID unless of course there is underlying concern by the LEO that to do so would somehow identify himself for later reprisals. Hope he gets what’s coming to him, this is a clear VIOLATION of RIGHTS and an abuse of power.

And then they need to be fired.

They work for US. They serve US. THEY ain’t nobody, and THEY need get used to it.

More likely it prevent the victim from being viciously attacked. That is what cops do when the “normals” don’t bow down and kiss their feet.

Hang on a minute, while the cop is certainly out of order. shouldn’t the guy not have leant against the patrol car in the first place? A buddy of mine has done a lot of sjit in his time but never been arrested. His formula for success: “I always say sorry and I always call them sir.”

Its punk cops like this I just LOVE to hear about in the news that get clipped in the line of duty! What a total POS.

ask yourself if it is a crime first?

Of course it’s not a crime! At the same time, ask yourself the same question this cop (whose subsequent actions I do not condone) asked Hamilton… How would you like it if I leaned my ass on your car?

It’s not the cop’s car. He can’t claim personal ownership and egotistical threshold over something that belongs to the taxpayers. My ass get to go on anything my tax dollars pay for.. Including that cop’s face.

If you actually listen to the video, it’s because he was trespassing on FEC property. The cop says so near the end and you can hear it. He clearly states he IS NOT arresting him because of the guy asking for his badge number.

What it looks like to me is that this guy had already been doing something, then he provoked the officer to get arrested on video. Now he thinks he is cool because he is “famous”. The motive sounds familiar to a story involving a boy in a balloon…

I’m sure you’ll be vindicated when once again all charges are dropped and Florida’s tax payers end up having to make a sizable deposit in Mr. Hamilton’s bank account.

I used to jump to the cops defense as knee jerk as yourself… but it’s not paying off these days with the amount of brain dead, juiced up, arrogant, overly aggressive asshats being allowed to wear a badge these days

That’s a cop being an asshole. I think people are tired of cops being assholes to them. I think you are a cop too.

There has to be some way to keep these small, pathetic, people from becoming cops. If not, then we need to rethink the entire institution. Thugs with badges isn’t working.

Cops; if you don’t want to be hated as corrupt thugs w/o accountability, behave professionally, and stop defending bad cops.

Uh-huh. Trespassing on FEC property. That’s why the actual listed charges saying nothing about trespassing, but say “RESIST/OBSTRUCTION, MUNICIPAL/CITY ORDINANCE, DOI”

i gotta agree with the langue d’oc guy. saying it belongs to the tax payers is like me robbing the post office and replying that i was just taking stuff that i paid for.

he should not have leaned against the guy’s car. after all, he is responsible for it. sounds to me like had he not leaned against the guy’s car, this would not have happened.

Actually Rick, I don’t think his ass stole any of the paint off the cop’s car. Sorry bad metaphor.

Spooner, any big city cop who stands up and does the right thing is going to get the “Serpico” treatment. He’d best not be putting in any time at the firing range or there’ll be an “accidental shooting.”

I witnessed an off-duty South Beach cop cut off another driver and then leap from his private car to scream at the innocent driver that he ought to arrest him. I told the other driver I’d be glad to testify as a witness at which point the cop turned on me and threatened me with arrest. I think only the presence of a dozen witnesses prevented our arrest.

The power over others seems to attract these jerks to policing.

I’ve lived all over the USA, and trust me, those BSO cocksuckers are the worst I’ve seen yet.

Had one tell me straight up, that if I was anywhere near a burglary, he was gonna scoop me up and pin it all on me. I was 19 years old. Never looked at a police officer the same way ever again.

Police are PUBLIC SERVANTS, with the common motto, “Protect and Serve”. Remembering that, any police officer should remember where his paycheck comes from. Due manners to the citizens will get more cooperation than attitude. There have been enough versions of the experiment on authority versus captivity/class and discrimination. The results SHOULD insure that officers need better training before they let the uniform own them, rather than their responsibility to the community by wearing the uniform.

(Unless, of course, his department has been privatized out to Blackwater?XE or KBR. We have seen how they handle their responsibilities.)

This is why we need mandatory drug tests for police officers whenever they are involved in incidents like this. Roid rage is not pretty.

Ft. Lauderdale Police have long been known for having more in common with the criminals on the streets than the citizens they protect. This cop is really no different than any of the other douche nozzles running around with a badge and a gun. It’s not about justice, it’s about their EGO– and nothing else. The cop could have said, please don’t lean on my squad car- he could have asked him to move- a thousand different ways that could have yielded other results- but he approached him as an instigator- and using his badge and gun as his back up to his ego. This guy should be fired- and everytime something like this happens- they should be fired- until we get the change in behavior that is needed. As long as we the people accept this- it will surely be excercised over us.
