Security guards harass cyclist for photographing trees outside prison

In the eyes of prison security guards, it appeared to be a scene straight out of The Great Escape when a man on a bicycle pulled in front of the prison and began snapping photos of the trees.

Yes, trees.

He was immediately surrounded by security guards in three vehicles who demanded to know what he was doing, which is always an annoying question when it’s obvious what a man with a camera is doing.

This is how he described it on his blog.

they had bullet proof vests under their “security” t-shirts and gun holsters with guns in their utility belts.  as one all three get out of each of their cars, i realize that i probably shouldn’t have stopped to take pictures.

the chubbiest of the three men asked in a kind-hearted manner “what are you doing?”  i explained that i was only taking a photograph of the sad-looking trees, he asked to see the pictures and after about 10 mins of interrogation to make sure i wasn’t a terrorist or trying to break anyone out, he let me go.  i nearly got arrested for this shot.

Besides the obvious annoyance of not using capital letters to distinguish sentences, this nameless photographer in a nameless state was under the false impression that the fat security guard was “kind-hearted.”

But that kind-hearted security guard violated his rights by demanding to see his pictures and used strong-armed intimidation tactics to make the guy think he was going to get arrested.

Even if the photographer was taking pictures of the prison walls or the guards themselves, there is nothing they could do about it as long as he wasn’t on prison property. And even if he was, they could just order him to leave.

It’s not like he was on the inside. So they didn’t have to treat him that way.

I live not too far from a prison, and I have stopped a few times (quickly) to grab some shots of things on the surrounding property. The land around the general prison has prominent no-trespassing signs which, on the bottom, list “photos” as things prohibited. I always wondered about the legality of such a prohibition. Thankfully I’ve yet to be confronted…but if I get much closer to the actual prison grounds, I’m sure I’ll get some personalized attention.

Those are odd trees. Can’t blame the guy for wanting a picture of them. I wouldn’t have bothered talking with a rent-a-cop, I’d have pulled out my cellphone and called a real police officer.

It’s perfectly legitimate for them to limit photography on their land with those no trespassing signs. However, there’s nothing illegal about standing outside their land and taking photographs.

That happened to me a few years ago, I was told I could take pictures but I couldnt stop the car. Makes perfect sense right?

The more people give into cop/rent-a-cops in these situations the worst in is.

It is not illegal for them to ask you to leave and stop taking pictures. But, in most circumstances, it is illegal for them to order you to leave and arresting you for noncompliance. The more people who do not question these things, the more likely that cops and RACs will not know how to handle a similar situation in a responsible manner. You only have to look at Carlos’ situation.

And I like the picture a lot.

If you look closely you’ll notice the faces, torsos,
and a couple arms and legs embedded in the trees. Those are HR Pufnstuf trees, hence the extra security. If you look carefully, you can see Witchy Poo in the background.

This is a portion of a response post from him:

No wonder they (Gubment goons) feel they can do anything they want. He (the victim) was content with them abusing him, and they let him keep his personal property to boot.

Hell if they had taken his wallet, bike, and shoes, I wonder how content he would have been.

This is similar to a woman who gets raped, but refuses to report her rapist, so the rapist just keeps raping women.

Footnote:
I understand it is hard for a woman who is raped to announce it, but it is no joy for a future victim either. This would have been a good chance for him to stop the continuance of abuses.

“thanks dude… i greatly appreciate your support. i was actually on the driveway headed up to the prison so i was already on prison property. i fugured their authority as i saw their guns and since i didn’t want to get shot by these big and burly security men, or pinned to the floor, as i am a small guy, i was quite content with them just interrogating and letting me go. it was quite annoying but at least they let me keep the shots. anyway thanks again for your support…”

Where it’s posted, “NO trespassing. No photography.” and you are on the land, and photographing, the de facto case against you for trespassing is complete. So, yes, they can arrest you.

There’s a separate question of the legality of barring photos on a what is likely state land, but that’s not really encompassed here.

I want to start out by saying that I am truly thankful for being mentioned on this blog. It is quite the most dandy experience I’ve had in my short time blogging. And thanks to all who have given support with your comments and such. Really, thanks.

I realize now, after reading this blog that I had a right, whether it would have been not to show those security gaurds my photos, demand a lawyer, or ask to see their supervisor. But like I said, I’m happy I got the shot.

I will keep this information in the back of my head for next time I am faced with such a situation. I wouldn’t however, compare my sense of content to that of a woman who is raped. My goal was to get the shot of the trees, I did and that was it. A woman who is raped, I doubt her intention is for that to happen to her. So there is a difference. But again, I am greatful for all this information and support.

As for my writing… I apologize to anyone for the confusion that may have been derrived from my refusal to use proper capitalization, shown in the brief excerpt and comment from my blog. However, please note that periods offer the same indication, if not more, of where sentences end and begin. Now that I know people are actually reading and/or looking at my blog though, I will make more of an effort to use all forms of proper English grammar.
