Lemonade Protester Gets Assaulted, Then Threatened With Wiretapping Charges

 

This video has it all. A cocky lemonade protester with a camera. A pushy pseudo-bureaucrat thinking he owns the street.  And a bumbling cop who creates his own laws.

It starts when activist Garret Ean sat on a public sidewalk during a farmer’s market in Concord, New Hampshire to sell lemonade during Saturday’s Lemonade Liberation Day.

A man approached claiming he owned the street, ordering him to pack up and leave.

The man identified himself as the president of the Concord Farmer’s Market, which apparently had a permit to operate on the street that day.

The man, whom Ean identified as Steve Blasdell, ordered Ean to turn off the camera.

Ean instead engaged him in a debate about what constituted vending.

At 2:48, Blasdell shut down Ean’s camera, but Ean turned it right back on.

That was when Ean turned from lemonade activist into  photography rights activist, claiming he was now “a member of the press.”

And that was when Blasdell tried to grab the camera from him after first trying to grab his cooler of lemonade.

The two men squared off with Ean accusing him of assault and Blasdell claiming it was not assault because he was only trying to swipe the camera from him without touching any part of his body.

Blasdell then ran off to call police while Ean announced he was giving away “free lemonade.”

Police arrived ten minutes later with one sergeant wrongly told Ean he was violating the state’s wiretapping law by recording them on a public sidewalk.

Ean offered to show the sergeant the actual law, which he had printed on a little card, but the cop refuses, saying he is already familiar with the law.

But then the cop once again threatens to arrest him on wiretapping charges if anybody else on the street complains.

Anybody except Blasdell, apparently, because the cops walked away without doing anything, allowing Ean to continue selling lemonade and videotaping Blasdell.

The video ends by Blasdell hanging up a handwritten note on a street sign behind Ean stating that the lemonade vendor is not part of the farmer’s market.

Ean said he continued selling or giving away lemonade for another two hours, raising $19 for the “Civil Disobedience Evolution Fund.”

How is it trespassing? The farmers market is open to the public, no fee is required to enter, and he agreed not to sell.

That is because it isn't trespassing. And he was mostly on the sidewalk, so it REALLY isn't trespassing! He could have sold condoms (or given them away, as it were) and it *still* would have been OK.

For the LEO on this board, the most important matter in this video, that a trained LEO was ignorant of the law and based his actions on that ignorance, is not important at all.

What's stands out in this video of a trained LEO basing his actions on his ignorance of the law is that a citizen is breaking rules which, seeing as the citizen wasn't trespassing and wasn't violating wiretapping laws, only seem to exist in the LEO's head.

It's not that the LEO is incompetent, but rather that a citizen dares to point it out.

This is sadly typical and goes a long way in explaining the disdain and general lack of respect which more and more citizens feel towards LEO's, which is unfortunate for the LEO's who are not incompetent and/or corrupt.

Like shooting a hancuffed man on the ground and getting a little over a year in jail for murder, or how about the foot dragging in Ca. over a mob (6 guys in blue) beating a man to death. What a place where a costume and a decorative piece of metal gives you prosecutorial immunity for crimes that us mear civilians would never see another day of freedom if we committed.

You tend towards the dramatic. Don't start crying about the Oakland officer getting a fair trial or the Fulerton deal when you still don't know what happened.

"Mear" civilians aren't tasked with arresting criminals. Police officers are.

Are you suggesting the police should have ejected him from the farmer's market based on an assumption of what might be granted in the Farmer's Market Association's permit in order to avoid having to determine whether he was allowed to give away lemonade? They would have to look at the permit and determine if giving away lemonade could constitute trespassing. That means that looking at the concept of trespassing doesn't simplify anything. Perhaps that's exactly what they did.

Facts that we do know include the officer saying recording audio in public constitutes wiretapping. The definition of oral communication in NH states there needs to be an expectation of privacy. Isn't that a problem?

That is because you erroneously believe so. The farmer's market doesn't get to enforce unconstitutional bylaws even if it enshrines them in its codebook.

At least he wasn't dumb enough to actually arrest him, qualified immunity is pretty shaky for cops on this topic..

I think this was how WWI started.

The guy is a dork. He should have paid to join the Farmers Market or left. I'm sure the opportunity to join was extended to him and edited out.

This isn't about kids selling lemonade at Farmers Markets or in the National Mall. These people are hurting the Lemonade cause with their actions which are just to bring attention to them. This is about kids selling lemonade in their driveways and being harassed to do all kinds of silly things to be able to do it.

You may be right that he should obtain permission to sell lemonade during a farmer's market festival from the permit holder, but what about the camera? That's a separate issue that both the police and the farmer's market manager were incorrect about.

The Farmers Market may in fact have a Permit for the street; but that permit most certainly does not apply to the sidewalk. An important distinction, and probably the only reason the CPD didn't arrest him.

I have engaged in Free Speech exercises alongside a local Farmers Market that were most unpopular with the President of that Farmers Market; but there was nothing they could do so long as I didn't conduct those activities on "their" street.

Bart, I have rec'd my "notice to appear" from the Gov't, it is for Sept. 12th (thankfully thats a Monday, so I can spend the weekend at Zion & Bryce. More National Park visits --- YEA!) :)

I hope the charges are dropped by the US Attorney that day! If not, I will be requesting a court-appointed attorney. As it is now, I have most of my ducks-in-a-row to *prove* that I was the victim on an illegal "terry stop" perpretrated by Park Ranger Steven Powers, and that both my 1st and 4th amendment rights were trampled on that night.
