Man Arrested For Refusing To Hand Over Camera Acquitted
Indianapolis police claimed they needed camera for "evidence"
A 66-year-old Indiana man who was arrested after refusing to hand over the cell phone that he used to videotape an arrest was acquitted Thursday.
Willie King was standing on his neighbor’s property on February 18 when he began recording police making an arrest.
The man was already in handcuffs but police were still roughing him up so King started recording the scuffle, according to WRTV-6.
The video shows an officer asking King if he was recording, saying he needed the video for evidence.
"You ain't taking (expletive). There ain't no evidence," King is heard saying on the video.
King was arrested and later charged with resisting arrest, public intoxication and disorderly conduct.
"I'm down there with his knee in my back and another with his elbow in my neck in handcuffs," King said of the arrest. "I'm 66 years old. I've never been arrested."
Now King plans to sue the Indianapolis Police Department.
King’s arrest is just another example of police using the “evidence” excuse to seize cameras.
So far, not a single arrest has stood up in court.

How much should you charge for a photograph?

Mr. King certainly seems to be a nice, upstanding person that's never been arrested for anything in his life. Never had any involvement with police until this fateful day.
Bart your day is coming.
"King was arrested and later charged with resisting arrest, public intoxication and disorderly conduct."
Apparently he was on his way from church to go help the starving orphans. Truly a (drunken) saint among men.
like a typical rapist blame the victim and drag them through the mud.
Come on Rich..
Did you expect anything different coming from "Johnny Law"? I wouldn't be surprised if "Bart" and "LawMan" chimed in with thoughts similar to "JL's".

I would lay good money on being "charged with resisting arrest, public intoxication and disorderly conduct" and combativeness are the most common false charges and or trumped up charges cops come up with to punish citizen who don't bow down and obey their betters fast enough.
Apparently he was on his way from church to go help the starving orphans. Truly a (drunken) saint among men.
What's your point? That only saints should be safe from getting arrested by poor delicate cops who can't STAND to be told to "Fuck OFF!"? Note that the cop wouldn't have received an epithet unless he had first challenged King about recording him.
Speaking of saints, are you some kind of sanctimonious tea-totaller? A man has a right to be drunk on his own (or his friend's) property without some thug cop hassling him.
"A man has a right to be drunk on his own (or his friend's) property without some thug cop hassling him."
Of course not, that's probably an automatic public drunk charge on general principle from JL.
I'm sure if we put you under the microscope we wound find that you have skeletons in your closet.
Note here that Johnny Law doesn't take this opportunity to express satisfaction that justice was done, that police who demand cameras as evidence without a warrant should be weeded out and the message sent to all LEO's that this type of sloppy, thuggish behavior won't be tolerated.
Note here that, instead of reacting like a LEO who cares about the quality of his fellow officers' work, Johnny Law points out that the acquitted was accused of being drunk.
And, I suspect, had the acquitted been given a concussion while being arrested, that would be fine with Johnny Law, as well.
I'm sick of hearing all the excuses by cops and their supporters for shit like this. "He shouldn't have sworn at the cop, he shouldn't have been drunk, he's no angel", and that's just for that guy. For other cases it's "they were too close" (when standing 10 feet away and backing up), it's "evidence", blah, blah, blah, blah, blah, on and on endless obfuscation and confusion to gloss over and hide the fact that officers when telling people to stop filming are giving out illegal orders, and when those illegal orders are not obeyed unlawfully arresting citizens. The fact that they are violating their first and 4th amendment rights never fazes these cops, and no matter how many cases get dismissed police continue to harass people taking video of them for the same reason a dog licks his balls. Because they can. If you think about it, for every citizen who refuses an illegal order to stop filming and gets falsely arrested there are probably nine who obey and shut off the camera. Until there is punishment meted out to officers for doing this it's a net win for the cops and they won't stop.
well said, and very true
we do have the right to protect ourselves also so if these dumb cops wish to let the courts settle it i am in favor of beating up the cops and let the courts settle a defense against unlawful orders under color of law and self defense.
jay...
I'm with you in principle. In fact I'm for using deadly force if that's what is needed. However, the fact is that resisting with force, unless you are actually defending your life will just cause you more trouble.
I would argue that you are always defending your life against an armed assailant. If they are already acting in an unlawful manner you can have no reasonable assumption that your life ISN'T in danger. This is particularly true when you are standing on your property.
Is it no wonder that cops are (allegedly) being assaulted more often. If you act like an unlawful thug you are gonna get treated like one. You deserve it.
I am so tired of the excuses too. Listen, here cops, WE ARE GOING TO RECORD YOU, DEAL WITH IT, YOU DON'T HAVE TO LIKE IT BUT IF YOU MESS WITH US WE ARE GOING TO TAKE YOU DOWN, WHETHER IT BE LEGALLY OR PHYSICALLY. You have been getting away with this shit for decades, well, get over it, with the multitude of cameras floating about you WILL GET CAUGHT.
And JL, STFU, to you there is an excuse 99.99999999% of the time, the only time you haven't agreed here when there is absolutely no possible defense. How many videos have to come out for you to realize its not just a few bad apples. While I agree there are good cops, the ration of good to bad isn't lopsided to the good side anywhere near where it should be.
When cops know or suspect a fellow officer of misbehavior, instead of keeping your damn mouth shut, DO SOMETHING, because when you don't you are an accessory to the crime. and no better than the offender himself.
i would rather be tried by 12 than carried by 8. we live in a time when you can get pizza to your house quicker than police. i say deputise the pizza guys and if they dont get there in time at least you get a free pizza.
That is funny..
A joke, but sad to say some of the pizza guys get murdered by thugs, there was a case where they called one to an abandoned building and killed him. But no gun 4 U pizza guy, no no no, just take it and die.
People are so flabby these days. It used to be 6, not 8.
you see JL shows the blue line mentality we are subhuman and they are better than us. we need to not act like cowards just because they wear a uniform they have to be reminded they are sevants and we are their masters not the other way around. and just remember JL has 25% chance he is a sexual preadator going by the stats.
Given police tend to have three times the rate of committing sexual assaults as the average citizen, does this mean you have an 8% chance of being a sexual predator?
would you also be included in that 8%.i think so
oh by the way the average IQ of cops is only 104 any higher and they wont let you become a police officer just google police IQ and see for yourselves.thats why a lot ex military guys are cops because they have been brainwashed to obey orders and get their rocks off and bragging what they did to the stupid perps.
It's the same for TSA agents. You don't even have to have a high school diploma to qualify. They want 'em stupid because most stupid people are happy performing otherwise mind-numbing repetitive tasks, lack common sense, and will apply the regulations as written, no matter how ridiculous and demeaning they are.
Is it time for the pigs to rot in hell yet?
i would like to see a foundation set up for alledged cop killers defense fund. i would make a donation.
