Man who filmed plainclothes cop pulling gun on him now threatened with prison
The audacity of the Maryland State Police is not that one of its plainclothes officers pulled his gun out on a motorcyclist after pulling him over for speeding.
We wouldn’t expect anything less from them.
The audacity is that they are threatening the man with prison for posting a video of the incident online.
The motorcyclist, an Air National Guardsman named Anthony Graber, was wearing a video camera on his helmet when he was pulled over. Not much different than the dash cams the cops use in their cars.
And the cop, as thuggish as he came across in the video, had absolutely no expectation of privacy when he pulled Graber over and pulled his gun out on him.
But now police are claiming that Graber recorded the cop illegally because Maryland is a two-party consent state when it comes to recording people, according to WJZ-13.
However, that law usually applies to when people have an expectation of privacy. Not when they are pulling a gun out on a citizen on the side of a busy road in broad daylight.
Here is an analysis of the Maryland law posted on the Reporters Committee for Freedom of the Press, which reveals that these Maryland cops are pulling laws out of their asses.
State courts have interpreted the laws to protect communications only when the parties have a reasonable expectation of privacy, and thus, where a person in a private apartment was speaking so loudly that residents of an adjoining apartment could hear without any sound enhancing device, recording without the speaker’s consent did not violate the wiretapping law. Malpas v. Maryland, 695 A.2d 588 (Md. Ct. Spec. App. 1997); see also Benford v. American Broadcasting Co., 649 F. Supp. 9 (D. Md. 1986) (salesman’s presentation in stranger’s home not assumed to carry expectation of privacy).
The obvious truth is that these cops are embarrassed about coming across as thugs on video. In fact, Graber thought he was about to get murdered.
“I was afraid. I thought the person, at the time I didn’t know it was an officer, was going to shoot me,” Graber told the TV news station.
Graber was cited on location for traveling more than 100 mph on his bike. He was also accused of popping wheelies. And Graber apparently paid the fines because the case was then closed.
But police showed up to his house more than a month later after they saw the video he had posted online.
Then they threatened him with prison after accusing him of breaking the wiretapping law.
Maryland is a two-party consent state. That means you can’t record somebody without telling them. It’s a felony to break that law.
That’s exactly what state police told the motorcyclist when they came to his house more than a month after he’d been pulled over.
“I don’t want to go to jail. I haven’t really done anything wrong. It wasn’t a violent crime. No one was injured. No one was hurt,” said Graber.
The Harford County state’s attorney is handling the case but has not charged the motorcyclist.
We’ve seen cops use that same law several times in several states only for it to be thrown out of court. This one shouldn’t even make it to court.

I conceal carry, if the filthy fucktard in this video had jumped out of his car and pulled a gun on me chances are fairly high that he would now be dead, what a fucking retard. I would have thought he was getting out of his car to steal my bike, perhaps he was a criminal on the run from the law, how the fuck would I know if he doesn’t identify himself? I predict that more and more of the filth are going to be killed, people just won’t put up with the bullshit for much longer.
I assume it varies from place to place, but in my area, unmarked cars and plainclothes people are not allowed to make traffic stops.
That thug is absurdly lucky he didn’t get shot by the motorcyclist. Anyone could jump out of a car with a gun drawn and claim to be a cop.
Sorry Maryland State Police, but have you heard of the Streisand Effect? It gets worse when you deliberately misinterpret the law in order to attempt to intimidate someone.

It’s facinating to learn that the Maryland police can simply choose to ignore a felony. If they had evidence that a felony had been committed (the recording) I don’t think they can simply decide not to enforce the law, especially as they took the trouble to go out to his house. It would be very interesting to see who initiated the visit to his house. Did the officer take it upon himself, or was he dispatched ???

You would show the tape to the court yet the cops are going after Graber for “illegal wire tapping”, seems like a double standard,imo. Was the marked unit recording ? If so the illegal recording charge should be trashed…as all parties knew they were being recorded. A helmet mounted camera should be evident they all knew it, too. Graber was probably backing up because he believed he was being bike jacked. It’s obvious Uhler appeared to be a non LEO mad man,until he verbally identified himself finally. I believe Uhler was in a totally unmarked car or pov……Graber probably wouldn’t have wheelied if it were marked so he had no idea Uhler was a LEO in my opinion.

Dodge Ball I suspect that you are being straight forward about your past; there are a lot of pseudo everything on the net these days. I will give you the benefit of the doubt and presume you are, or were what you say you were.
I never said in anyway that I was a professional videographer or had forensic or enhancement training in this media. Oddly enough this video showed up on a site that I frequent quite often and usually is more political in content. However there was a link and having been a biker quite a few years ago it caught my interest, so I took a peek.
What I noticed first off that the majority of comments on the site were of a violent nature directed towards police in general. You made a similar remark, which being retired I suppose you’re entitled to do, coming from a former DOJ employee and a star carrying law enforcement officer for twenty years is puzzling to me.
No I have not had any police experience personally, but I have, shall we say a relative who is a high ranking law enforcement officer. He lost a good friend a few years back a Parkway Patrol officer shot once in the head from a 9MM. It was a routine stop the vehicle which it turns out was stolen had a brake light out. He was twenty seven, a good man, wife and two kids. They traced the car went to the address the man there was surprised the car was missing along with his 9MM pistol and pump 12 gauge. You may be familiar with this case a client of mine who is retired FBI remembered it.
Than there was the officer who was on a narcotics stake out when the perps started to leave, he was told to wait for back up. He chose not to, they found him behind his car machine gunned to death. He had a 357 and three speed loaders he had used two and was attempting to load the third when he was killed, at least that’s how it appeared, cylinder open speed loader on the ground six shots still in it
There also was a Deputy Sheriff from Flagler County Florida in another routine stop took four shots in the chest through the darkly tinted driver side window. This was awhile ago must have been early seventies, prompted the limit on tinted glass darkness in Florida. Shortly after was the emergence of the bullet proof vests.
What I am trying to convey to people is firearms and incidents are volatile and things can get deadly in a New York minute. In this instance I think had the officer pointed the weapon directly at Mr. Graber then there would have been cause for out cry. However; on this case there is a fine line between being prepared and being dead. Hypothetically say the suspect on the bike just killed someone and is fleeing the scene of the slaying still carrying the weapon inside his jacket. What if the officer exited his vehicle with his weapon holstered you think he’d be dead? This is a gray area. Mr. Graber did drive at excessively high speeds, yeah eighty miles per hour, right, in a willful and wanton reckless manner bordering on criminal negligence. You as a former patrol officer don’t see it that way eh? I find that a bit odd.
You still say he, Anthony Graber, was only doing 80 MPH. Yet if you go to 0:36 on the video in 720HD the speedometer distinctly shows 127MPH. You may have to bump the slide a little until the clearest resolution is obtained, but its there. The bike rises up again with the shift to the next gear at 0:36 and then again with the next shift at 0:38. It was my experience while accelerating on my bike to notice this lift of the front of the bike when I was accelerating and only then; unless I was rolling over a curb or something. If Graber was decelerating at this point the bike would have nosed forward and down, it did not.
Graber is passing traffic left and right like a bat out of hell until 0:46 when he decelerates quickly. Your right from here on out he is moving along with traffic and is even passed by a car, the Green Honda, I think it’s a Honda, with the gray primer. Dodge Ball I ‘m confident you know the operating parameters of your bike as I did mine. The link I gave for the CBR1000RR was not for the experienced biker who understands the operating fundamentals of this type of motorcycle but for the less experienced or novices out there that may not understand the performance capabilities that lie therein. Make no mistake people this is one fast bike from start through fourth gear it is one flying machine.
I don’t want to reveal too much about myself, I’ve been around for a bit; I was an owner operator of a White Freightliner and 40 ft Great Dane refrigerated trailer, ran mainly the east coast from Boston to Miami and everywhere in between. Why do I bring this up you ask? Simple there are two tractor trailers passed by Mr. Graber before he wheel stands past the bus. If I were in either of those tractors I would already have known from my CB (Citizen Band) radio that there was a Bear sitting at the center median at mile mark such and such, and if I had my foot in it as you imply that everyone was going fast, rest assured these truckers were not, they were in maintain the legal speed limit mode.
Mr. Graber resumes a normal speed at what I believe is 0:46 on the video, 20 seconds up the road at 1:06 is the trooper in the center median on the left of the screen.
I am confident that the Harford County State Attorneys office will most assuredly employ the use of an experience videographer with forensic and enhancement qualifications that will give credence to what is on the video. If I were representing the State Attorneys office in this case I would have a specialist from Honda motorcycles in attendance as well to give expert testimony on the CBR1000RR and to give his account as to what is on the video and how it progresses.
What I am asking the people on this site to do is look at the areas on the video that I have found and see if you don’t concur with my interpretation of the events as they unfolded. What we see is what we know as fact, the interpretations vary according to individual perspective, and a court of law will undoubtedly sort it all out. The rest of this is speculation and conjecture as far as I can see, in the court of law all hearsay evidence.
Your worked for the DOJ shouldn’t there be legal briefs already filed by Mr. Graber on the video taping and wiretapping allegations set forth supposedly by the state at the time of arrest? Where are these documents now? Has anyone checked to see if such laws even exist in Maryland State Statue? What did Mr. Graber say to the LEO’s after the tape was turned off? What ensued thereafter, what were Mr. Graber’s actions toward the officers at the time of his arrest? Why was Mr. Graber video recording his ride to work that morning was this wheel stand event premeditated? There are numerous unanswered questions and I’m sure more to come.
Lastly I picked up the handle Squibster from the word squibs: a small electric or pyrotechnic device used to ignite a charge. I could have been a Squibs but I would have had to pick a number, apparently it must be a popular handle. So I said okay I’ll go with Blaster, another popular handle. The reason I bring this up is the fact that you felt the need to address me as Squibby. The name Squibster is derived from another profession I dabbled in while in the military. I was a combat engineer demolition specialist; Blaster. 1966-1972.
The Hurt Locker movie was realistic and had me on the edge of my seat with that cold sweat popping out on my brow, until he yanked the wires connected to all those buried shells. That is in demolition a basic no-no; I use to rig our stuff for the ….Nuff Sed!

I think that what is even more frightening is this obviously off-duty officers actions was his total disregard for his training and proper police procedure. First of all, by pulling in frount of the biker, and opening his door, he left himself completely exposed, say if the biker had been ” an armed robber ” as SQUIGLEY aptly pointed out. Secondly he put the uniformed officers life in major jepordy, if there had been gunplay, since he was in the direct line of fire. I have never seen such a poor display of tactics in my life. (and I have seen many) If I was an officer in his department’ I would see to it that this idiot was drummed off of the force. There is no way that I would have this moron backing me up , in ANY situation. This video should be used as required training material in all police departments.
@ Kevin I agree. Therefore, these actions show Trooper Uhler didn’t believe he was in fear of his life, so firearm didn’t need to be drawn.

I salute your nobility and service during some dastardly times, Blaster. I agree with you about the dreamers out here on the net. I’ve been scared shitless, roasted in a Second Chance, have seen a lot of wild and nasty stuff, and made my way through it all unscathed, mostly. I’ve been mildly stabbed, received a concussion, and have had a few broken bones, not to mention being hit with a big dose of CS in a mishap…… Kinda funny, now that I think about it.
The ire I expressed towards Uhler was in reaction to (and in valid contrast to what you stated) the fact that a weapon was presented and pointed into Graber’s direction with absence of mandatory protocol. My possible reaction would have been justified. Graber was static, had no cover, and was essentially inert. Uhler’s weapon should have been kept in its holster. He’s a state trooper for God’s sake. Wouldn’t one with a marginal amount of common sense realize that he should have enough proficiency to draw and fire a whole lot faster than Graber could even possibly have if he had the initiative to? Please understand that Uhler was in no legal and physical position to do what he did. He was absent from direct radio contact, he undoubtedly had no body armor, was poorly positioned, and failed to display any type of immediately recognizeable identification. He had plenty of time to set that up if his thinking processes were in order. The presentation he made was in very poor judgement, particularly when a uniformed officer and his unit (with dash cam) was directly behind Graber. I don’t know about you, but being placed into another officer’s potential funnel of fire is more than unsettling.
Ultimitely, the real issue is the video recording, the arrest, and the search and seizure foul-up. The traffic thing is done, regardless of whether the Honda was going five over or at mach 2.
In 1986, I actually received training in officer survival from one of the FBI agents that survived the shootout with two bank robbers in Miami many years ago. It was admitted that there was an absence of preparedness combined with tactical disadvantage. I believe one of the subject’s name was Mattix or Maddix. Anyway, there are similarities in both scenarios. I could see a small town municipal officer making those mistakes, but a state trooper? Sorry, but if he were gunned down, it would have been no surprise.
Dodge Ball I would suspect you and I are of a similar age, but we won’t go there. I am reasonably certain that you are who you say you are and knowing that I commend you and thank you for your service. I know all to well from “that” relative of mine not only the danger involved but the thanklessness of the position.
Are you referring to CS riot gas? I was subjected to what we were told was CS riot gas early on in my military years, turns out it was VX gas. It wasn’t until I was back stateside that I came to realize we had been duped and used as guinea pigs. Ever have any VX experiences? Dodge I’m glad you didn’t say C4, it only takes a small dose of that plastic to do serious damage, that and squib huh?
Getting back to Anthony Graber; I think I know what trooper Uhler was attempting to do and in doing so placing him, Mr. Graber, and others at great risk. He saw an opportunity to isolate the suspect vehicle, Anthony Graber’s motorcycle, from pulling forward or fleeing down the exit ramp to the right of the screen in the video. I have been told be a few people in the know, liken to yourself, that Trooper Uhler made several tactical errors in executing and acting on a poor judgment decision.
One point similar to yours, about placing himself in the line of fire from the uniformed trooper coming up the hill from behind the location of the pull over/cut off, was; what if the suspect on the motorcycle took flight what would Uhler have done then? There are some serious questions about police procedure and protocol. There is still a lot of speculative reasoning going on as witnessed on the content of the comments on this site.
I think a full investigation is warranted into the aftermath of Anthony’s escapade and what transpired after Anthony’s slow down period on the bike. I suspect that Anthony undoubted will lose his motorcycle license in the State of Maryland at least for a few years, providing that State issues strictly motorcycle licenses. He will probably be handed a pretty substantial fine and hopefully serve no jail time.
In 1969 when there was an estimated 80% less traffic on the road then there is today. A good friend pointed that out to me during an oil change, he said when was the last time you used your high beam headlights at night? I told him I definitely never use them during the day it seems so pointless. A simple question, hardly ever bordering on never, the reason being is there is always someone on the road 24/7. This is an old timer’s critique on changing highway conditions.
An amusing related story, its 1969: I was coming back from S.U.N.Y in Albany heading south on the N.Y.S thruway. I had gone there to hear the “Band” playing in concert at the University where my girlfriend of the time was going to school. It’s 8:30 in the morning on a Sunday, like the song says “Easy as Sunday Morning”. Beautiful weather early spring, cool, morning dew in the air, the roads are dry I’m just outside of Greenville N.Y. and doing 68 MPH in a 1966 GT Ford Mustang, 289 cu.in, Holley 780 double pumper, there’s no one, I mean no one on the road a car every 3 to 5 minutes heading north on the other side of the thruway. Fords love cool damp weather that’s when the run best.
I tach it up I got a 3.05 rear and fifteen inch rubber I’m going for a “blow the carbon out high end” cruise. This car would do140 MPH, been there. I’m in fourth gear 135MPH going under this bridge all you hear is tuned exhaust and wide open secondary’s on the Holley carburetor, what a SWEET sound that was. I’m still pulling up to the 140 mark when low and behold there’s a glint of eastern sunrise on something in my review mirror.
It’s Smokey and he is coming on like gang busters, black smoke bellowing out the dual exhaust, just black smoke a glint of sunlight and a little pinkish red twinkle in the center of the whole mess and twenty miles to the next exit. I’m hoping the black exhaust means cold engine and hoping that it will come apart, but not likely, big block police interceptor was a hardy pursuit vehicle. In this situation under these circumstances what do you do?
I did what Anthony did I slowed down and let him catch up to me. At that point I knew we had a conflict of interest although he appeared a few years older then me, we were worlds apart. He was all spit and shine probably never knew what a demerit was never having gotten one. Me, heck I’m one long haired freak with a beard, bell bottom blue jeans, square toed stacked heel cowboy boots. Actually I wore them for several years driving that Freightliner I mentioned last posting here. . We were from to different worlds, what made it exceptionally worse for me is I was wearing a West Point Cadet jacket, the gray wool coat with blue insignia and what appeared to be hash marks on the sleeves, it was cool that morning so I was wearing a coat right, obviously the wrong coat for the occasion it would seem. The early morning, no one on the road, blowing the carbon out, defense didn’t work, I think it was the coat but I’m not entirely sure. Not only was I issued an excessive speed ticket but I got to ride in the back of a State Trooper car handcuffed.
Found myself in a magistrate’s house at about half past nine that Sunday morning, in his basement actually, he was in his underwear and wearing a robe and I could hear family life happening upstairs in his home through a partially opened basement stairwell door… Disposition came to, normal speeding ticket (I believe about $70.00 then) plus $1.00 for every mile per hour over, plus towing and impound fees, they towed that car twenty six miles. Let us not forget court costs. It was more money than I had so I was sent to jail. I was there for twelve hours before I raised enough money through that one phone call to a good friend from New York. He paid my find and I went and got the Pony Car and went back to Florida. It was one beautiful Mustang I wish I had it still, no strips down the surface of the body just the Ford GT above the rocker panels below the doors and that short white stripe from inner wheel well to inner wheel well.
Bikes, road one through the seventies in Florida, I called it my Japanese Triumph. It was Yamaha 650 Twin with an eighteen inch Harley wheel on the back and Pirelli rubber front and back. It had a custom Sportster style tank and was pretty much set up as a café racer, both the front and rear fenders were cropped and the bike was painted a dark black. Those were some interesting times.
As for Anthony there is a time and a place, I’m not going to be a hypocrite because I got busted on a similar charge, I just don’t think I would have pulled a wheelie and hit those speeds on that stretch of road at that time of day, that being my personal take. A good attorney under these circumstances may be able to at least lessen the charges against you if you’re lucky it may wash completely I think that to be a long shot though. FYI a eighteen wheeler loaded, 35-40 tons needs roughly a quarter mile to shut down completely, had anything happen mechanically to the bike at that speed next to the white bus your odds for survival were slim to begin with even if you managed to keep some semblance of control you got a loaded semi bearing down on you and there’s no way he’s going to be able to stop. Even if he gets the tractor past you you’d probably get caught up in the trailers tandems. No doubt you’ve got the intestinal fortitude to do what you did that is a given as evidenced in the video. It is my experience that every time we get on the road we are gambling that we will get off the road safely and in one piece. You can never be sure what might happen or where the “outs” (a path in case you need one to get out of a situation) disappear for whatever reason. Here’s some advice for the road from an old trucker and biker, “don’t get into anything you can’t steer out of”, that’s key.
As for LEO’s there are good and bad no doubt, I have other stories about that especially while trucking. I will hazard a guess here Dodge Ball I believe most of the people, like you, initially become law enforcement to protect and serve, and to try to be assets to the community in general. It’s unfortunate that some of them go bad, but may be they are bad to begin with, or the job makes them that way. Dodge Ball you’ve seen the reasoning behind my internet moniker, I believe I see yours, in which case I’m glad you zigged when zagged could have been a bad day for you. Keep dodging the bad things life may throw at you and I’ll try to do the same. Peace Brother.

Yeah, a lot of us have an uncle that we only invite to the family reunion. Some relatives aren’t missed all that much, are they? No plastique or ball bearings, just a lot of flash-bangs and some det cord. Thank God.
I believe that my analysis of Uhler’s actions are pretty much on the mark. Body language and facial expressions reveal a lot. If he would have just put his anger on the back burner, put his ego on hold, and got just a little more cerebral, he wouldn’t be in such a pickle.
I once spent an afternoon on the judge’s front porch drinking lemonade and eventually making a few bucks from mowing her lawn to help pay the fine from speeding on my 1972 Suzuki. You know, I cherish those moments as they are days of real Americana lost.
With no disrespect intended at all, you now somehow remind me of the character in “Uncommon Valor”.

you need to read up on your “laws”….do you know the difference between “lawful” and “unlawful” or “legal” and “illegal” for that matter?? (smart ass)…well here we go… “lawful” or “unlawful” is known as “common law”, which iiiissss the law of the land or the law of the people, meaning anything that evreyone can agree on that is bad. i.e. murder, rape, theft… well causing someone a loss in general. “legal” or “illegal” is “statutory law” or “contract law”, which are laws regarding “contracts” , i.e. your driver’s liscense, social security card, etc. those are all contracts that you don’t have to sign…you do that voluntarily……oh and registering your car is a contract also, and when they give you a tag that gives the “statutory law” enforcement officers the right to do anything they want to you on a public road…..there are however “legal” (not “lawful”) steps that you have to take to get rid of those thing’s you just have to research it……but when you do……YOU ARE A FREE MAN……and only “common law” applies……;-)….HOW ‘BOUT THEM APPLES!!!

Sorry I got in on this late just saw the video. Was right up there getting pissed with some others til it came to the end of the little snipet and lo and behold what did I see but a Maryland State Police Unit with a uniformed trooper standing beside it.
Is it possible that this rider was involved in a pursuit? OMG tell me it is not so. The full video revealed he was acting like an ass on the freeway and passed troopers did he not?
I dont know if the trooper in plain clothes was off duty or was an investigator or what but he is in a MSP vehicle.
In some states what the rider had done would be considered a felony. It does not matter his skill level what matters is the skill level of the 75 year old woman who sees him pulling this shit and panics causing an accident and killing the four kids in the minivan behind her.
It is obvious by some of the posts that you never even watched the whole video or saw what you wanted to see.
Should the trooper exited with a badge, yep probably so would have made things crystal clear to all concerned. Should the dumbass on the motorcycle stopped fleeing from the police when they got behind him? Yep without a doubt.
But once again we see what we want to see and the person who edited the video to show what they wanted to show is the one who should be blamed for all this. Show the whole damn thing truthfully and let us decide what is right or wrong not show what you want to show to cause an uproar.
You are quite correct that the behavior of the cyclist is reprehensible and he could be charged with AT LEAST wreckless driving. However, what you fail to see is the broader danger to society when the police begin acting like gestapo rather than like police officers. It matters not how egregious the behavior of the motorcyclist, the police MUST maintain their professional standards. His failure to do so presents a MUCH LARGER danger to society than any wreckless driver.
First of all, to all you ignorant dip shits. This douchebag on the motorcycle was travelling 100 mph doing wheelies which shows he has no reguard for his safety not to mention all the vehicles around him. He had a deadly weapon (the high speed motorcyle). It would take a fraction of a sec for him to have killed someone. I don’t care about him putting himself in danger but what if my wife and kids were in the vehicle next to him. He had a high possibility of crashing into any one of the vehicles, especially riding with one hand. Secondly, the badge was on the officer’s belt right side, you can see it in the video. The officer had to jump out and take action, it would again take little effort for this wreckless driver to speed off and kill someone. The officer never pointed the gun at the Violator/Criminal/Douchebag, whatever you want to name him. But now-a-days its always the officers fault. Well I’m glad I have common sense. If the douchebag wasn’t going 100 mph he would have never put other lives in danger and forced an off duty officer to stop him. That officer saved atleast one persons life that day possibly more…even though the life he saved was a douchebag. Lastly, if Douchebag crashed and killed people…The head would be “No officers enforcing traffic laws…Family killed.” Typical BS
The issue here is not what Graber did and has paid for, it is the fact these cops got a search warrant, I repeat, a search warrant, signed by an anonymous judge. With the foundation starting with a traffic infraction, man, that is crazy.

Okay, first off, the report states that he was going 100 MPH and popping wheelies. The motorcycle, going that fast, IS a deadly weapon. There is no debate of that. He could easily have crashed into the cop going that fast, so surprise, the cop was on edge. As a plainclothes officer, he had a badge on his belt. He most likely didn’t notice that his loose jacket was covering it. If it wasn’t covering the badge, he wouldn’t need to say “Hi dangerous speeder! I am a law enforcement officer! By the way, get off of your motorcycle before you take someone’s head off!” The motorcyclist would have easily been able to see the badge on his belt. This is blown WAY out of proportion, especially considering the fact that the officer never pointed his weapon at the speeder, and acted in a calm and cooler manner. He never even raised his voice at the guy. On a side note, the man’s claim of being “afraid of being murdered” is total BS made up out of fear of getting arrested. There was a uniformed officer not 10 feet away from him assisting with the arrest.. This guy is obviously just fear mongering to try to get out of a stretch in jail.

As a “plain-clothes officer”, Herr Uhler had a higher responsibility to identify himself and show his purposely hidden badge when assulting a citizen. The problem here is not Graber’s behavior, it is Uhler’s. Uhler had no business making a traffic stop with his weapon drawn in the first place. He had even less business later bringing trumped up charges because he was angry and embarassed that his own thuggish and out of control behavior was shown to the world. Uhler’s continued petty, vindictive, and malicious behavior is clearly not in the interest of the general public or justice. What kind of oath did he take? To destroy anyone who pisses him off? Actually it was:

I don’t have a problem if the guy goes to jail for his speeding. However, he should not be charged for recording audio.
I just can’t understand how a reporter can make this statement, “Maryland is a two-party consent state. That means you can’t record somebody without telling them. It’s a felony to break that law. ”
This statement is NOT exactly correct and it should not be stated this way. A reporter should have read up on the law and should understand it before making such statements.
No one is disagreeing with you. The argument is that he should have announce that he was an officer and then drew the weapon. To the idiot who thought it was cool to speed, it seemed like he was getting jacked.

A plain clothes LEO pulling a gun out in the middle of the road without identifying himself quickly is dangerous. He put himself, the motorcyclist he was trying to stop and bystanders at risk. I’m sure the Maryland Police have protocol that should have been follow but wasn’t.
You will get no disagreement from me that the motorcyclist was be reckless but he paid for his actions.
Yes, he’s guilty of speeding and reckless driving, neither of which require a gun to be pulled. The gun was pulled before the officer identified himself, though with an unmarked officer in front of him and a marked behind him it stands to reason that he knew it was a police officer, but there still was no justification for a gun to be drawn. Following your logic, every other driver passing by in the video was in possession of a deadly weapon (cars can go fast too). At the time the officer pulled the gun, the rider was on a stationary bike. Riding a motorcycle at unsafe and dangerous speeds is bad. Pulling a gun in a non life threatening situation is bad. The larger issue is the visit to the riders house about the video.
As a resident of Maryland, this does not surprise me. I have been pulled over so many times for BS reasons, when cops are bored and HOPING for something to make their lives more interesting.
Maryland police in general are useless.
I do agree, he could have stated “I’m a Police Officer, Turn the bike off!” It would be good if he was able to hold the badge in his hand. An officer can pull his/her gun any time he/she feels there is a POSSIBLE threat. Officers have to react to someone’s action which puts them behind the curve and constantly in danger. Now pointing it at someone is Totally different in which he did not do in this case. You better have darn good reason to be pointing a gun at anyone. The deadly weapon I was speeking off was the 100 mph bike, not the other cars assumed to be doing the speed limit. You are right, an object (this case a vehicle) at any high rate of speed could be considered a deadly weapon. The recording thing, it’s a fine line with whatever the state law says but all laws are interpreted differently. My opinion is that the rider was filming his stupidity and did not have the intention of filming any perticular person or other incident. I’m sure he couldn’t just hit a stop button, but he could have stated his helmet video was on so whatever actions and statements after that fact would be legal according to the law at question. The Police patrol video is already known to be in the Police cars, which covers the sencond party knowing they are being recorded. Assume all Police cars are recording…even though not all police cars are equipt with them. Either way you don’t threaten someone with jail time for an unintentional recording. If someone accidentally recorded someone committing murder, would that person go to jail too…no that person would be a hero so what’s the difference? Leave the video alone.

Most jurisdictions police officers have to inform someone that they’re audio recorded.In these cases the video isn’t the issue it’s the audio. These wiretapping laws have been twisted to suppress video that someone doesn’t want seen.
I’ve gone back an forth over whether the office should have pulled his weapon. While it is true that the motorcyclist was dangerous going 100 mph. When the officer approached him he was stationary and not endangering anyone else. And after he found out the person was a police officer he complied completely with the officer.
WF, I’m not sure how it is for the local police in my area, but NYS troopers aren’t allowed to pull over anyone if they’re in an unmarked car.
That rarely happens. I’ve never heard of cops informing people that they are being recorded. They don’t need to unless it’s in a private area like a phone call.
The motorcyclist was a danger to himself and others, as much as anyone else speeding.
The plainclothes officer was an even greater danger, jumping out of his vehicle, weapon drawn, for a driving infraction.
