N.C. judge who convicted woman for videotaping cops faces reelection
Normally I wouldn’t give a rat’s ass about a local election in North Carolina, but now I want to do anything I can to make sure Judge Beth Dixon loses her reelection bid for Rowan County District Court Judge come this November.
Dixon, who has served as District Court Judge since 2002, last week convicted a woman named Felicia Gibson for resisting arrest for refusing to go back inside her house as she stood on her front porch videotaping police making a traffic stop.
Salisbury Police Officer Mark Hunter actually arrested her inside her home in November 2009, which is reminiscent of the Texas case where a cop followed a man inside his home and arrested him for “illegal photography” as well as the recent case of Arkansas cops arresting a man who stood on his property and called the cops Nazis as they were making an arrest.
But charges in both those cases were dropped by the time they got to court as they should have been in this case.
Dixon obviously has no respect for the Constitution, especially the First and Fourth Amendments.
The conviction stirred a protest as well as an editorial in the local newspaper, questioning how can someone be arrested for resisting arrest for documenting police from their own property?
The resisting-arrest conviction last week of Felicia Gibson has left a lot of people wondering. Can a person be charged with resisting arrest while observing a traffic stop from his or her own front porch?
Salisbury Police Officer Mark Hunter thought so, and last week District Court Judge Beth Dixon agreed. Because Gibson did not at first comply when the officer told her and others to go inside, the judge found Gibson guilty of resisting, delaying or obstructing an officer.
Gibson was not the only bystander watching the action on the street. She was the only one holding up a cell-phone video camera
As a guy who’s been arrested twice for resisting arrest for photographing cops, including one where I was convicted because of improper evidence allowed by a biased judge, this case really aggravates me. Documenting police against their wishes is not resisting arrest.
Obviously, the cops will use that charge against people because there is no law in the books that specifically forbid the recording of police in public.
But it’s up to the judges to keep the laws straight, which is where Dixon failed.
That is why she must not be reelected this November.

Gibson plans to appeal the case and I have no doubts she will have her conviction overturned as I did in my appeal.

That Judge should actualy be arrested on fedral charges for infringing on constitutional rights along with being DISBARRED. yes you can take it to the North Carolina Bar and have her removed from office even befor the election MUAHAHHAHA i know devilish huh….
Anyway if this judge is smart she will take a second look at it and overturn her own ruling OH WAIT SHE CANT ooooopppps talk about a fuck up on her part.

So now it’s perfectly legal to arrest someone (using the set of circumstances and situation in the above article), under the guise of “resisting arrest” because they’re standing on their front porch taking photo’s.
I’m going to love to see the spin “Johnny Law” tries putting on this one!

Seriously though, I am surprised that this arrest was made, much less that they obtained a conviction. I’m pretty sure I don’t have the authority to order someone to go inside their house when they are just standing on their front porch.
I guess the rules are different in Bumfuck, NC.
Glad to see this getting some attention. This made a fairly big splash on reddit a couple days ago. The excuse given by the arresting officer was that the “situation was dangerous” and that’s why he ordered the defendant inside her house and had nothing to do with her videotaping the scene.
Now looking at the video, it looked like the situation was perfectly safe and that it had everything to do with singling out the cameraman.
Guess she should have minded her own business.
This is obviously another case of “contempt of cop”. The cop thought they were laughing at him. As for safety I mean really, the incident is at least 50 yards away.

NC? What is the world coming to, a black person ( a woman at that) sassing a WHITE cop? This is what happens when you start treating them as human, first the buses, then the water fountains. Now they have the gall to sass a white man. Yeas them drakies just don’t know there place. Good thing we had a good ol boy cop and southern judge to put her in hers.
The conduct of the police is EVERYBODY’s business. Policemen who are doing their job properly have nothing to fear from cameras… only those who have something to hide worry that the public will see what they are doing.

Once again Johnny Law surprises me. I’m no longer pigeon-holing this guy, although I still suspect he sides a little too much with his brothers-in-blue. But we’ve seen a few cases now where Johnny agrees with us that things went too far.
Too bad my PC restarted since she nuked every single comment that wasn’t positive on her page.

“Re-elect Judge Beth Dixon I am prohibited by the Code Of Judicial Conduct from publically [sic] commenting on any pending case. My decision was very fact- specific and I do wish that I was able to discuss my thought process. The good thing about our system is that Ms. Gibson has the right to appeal my judgment and I take absolutely no offense to her decision to do so.”

“Judge Dixon could have issued a written ruling to express her thought processes, assuming she has any other than wanting police union contributions. I don’t see why she still can’t write one.
“And the right to appeal won’t mean much given the deference an appellate court gives to factual findings. As Her Honor stated, the case is very fact specific. Further, appeals are expensive and you don’t get your money back if you win. Trial court judges and DAs in misdemeanor cases especially bank on the fact that rarely will the apppellate option be exercised.”

It’s funny how the police are allowed to speed and the common citizen is not. The police are allowed to have illegal drugs in their vehicle and the common citizen is not. The police are allowed to carry guns to places the common citizen is not… And now the police are allowed to video tape us during traffic stops and you guessed it… The common citizen is not!

I contacted the North Carolina Tea Party to try to get them interested in Ms. Gibson’s case, but they responded that they are far too busy to concern themselves with such a matter. They are too foolish to realize when they have been given a public relations bonanza.
Is anyone running against her? Many times these judicial candidates in small elections are unopposed. Who’s her opponent?

While I don’t know the circumstances of the Alaska officer shootings, it does not automatically mean that the cops did wrong. While we see many cases of excessive force and inappropriate use of the law here at PINAC, do remember that the cops do have to deal with some less than honorable citizens. And while I often disagree with JL, lets wait for the facts before painting all cops as “Bully’s”.

Find out his opinion on that case and/or recording police activity before donating. You could be supporting someone who is radically more anti-citizen recording than Judge Dixon.

The DA is trolling for votes. The judge is a rubberstamp. Both should go.
Holy Shit, I am from Rowan County, and still registered to vote there, I think I will have to go fly back home after classes to vote this November.

I’m pretty sure the cop has the authority to tell her to go inside her house if she is in he vicinity of an arrest. It appears pretty clear that we have an insecure cop situation here, and I would say that his reasons for ordering her to go inside were some level of inappropriate or wrong. However, if she did not comply with his lawful request, she is breaking the law.
Yes, the cop needs discipline or dismissal.
But she may not be innocent!
This is a clear cut case of the law being used in a manner it wasn’t meant to be used. The cop was being an asshole – but staying within his asshole-rights. he didn’t do anything illegal, and technically he can arrest her. She shouldn’t have been doing what she was doing, but she shouldn’t have been arrested by the cop for such a minor infringement. obvious abuse of the power he’s given with that badge. both him and the judge should face suspension.

I just tried to go to her facebook page; either the Judge removed it completely, or she has blocked IPs, maybe mine? Anyway, it is interesting that I cannot get there now! perhaps calls to the TV networks could help bring this matter into more public scrutiny, especially in Salisbury NC!

has nothing whatsoever to do with race or region. i am a white woman who got arrested for sassing a black cop in durham, nc… was charged with resisting arrest and would have been convicted by a black judge had i not agreed to community service and deferred prosecution. i’m still on probation and still doing community service.
did it have anything to do with race? hell no. it had to do with out of control cops who think they are above the law… it doesn’t matter the color of their skin or the color of the citizen’s skin…
