A New Hampshire high school student who video recorded a police officer smashing his friend’s head against a table was ordered to delete the footage.

But Mike, a 17-year-old junior at West High School in Manchester, was savvy enough to delete a couple of photos without deleting the video.

He then gave the video to Cop Block, who posted it online along with video interviews of Mike and his friend Frank, the student who was abused by the cop.

The incident took place Monday in the school cafeteria after Mike noticed Frank being questioned by Manchester police detective Murphy, who is the school’s resource officer.

Frank had taken his sister’s purse in a typical display of sibling horseplay, which drew the attention of the officer and an assistant principal.

The officer took the purse from Frank, who then handed it to the assistant principal, who began rummaging through it.

One of them told Frank he was suspended, which prompted him to ask, “why the fuck am I suspended?”

That prompted Detective Murphy to grab him and slam his head against the table.

Meanwhile, Mike was confronted by a teacher for recording the incident.

“You’re recording something you’re not supposed to be recording,” she told him.

Mike firmly stood up for his rights and continued recording.

Frank was jailed on charges of disorderly conduct and resisting arrest.

Way to go, Mike! I just hope you don't get suspended yourself for making school officials look like idiots! (Actually, you didn't make them look like idiots, they did that to themselves...you just recorded it.)

it will be interesttng to see if the school will take further action against mike i don't think this is over for mike as the school may try to take further disciplinary action

Try is the operative word..

As I've told my daughter, if you are right I'll back you. And if you ever feel uncomfortable about a situation you simply say "you need to call my dad" and not to let them bully you into not having them call me. I'll decide what is going to happen, if I don't agree with them and they don't back down they get sued. If she's in the wrong she will be punished.

I also made a point that if you video something with your phone and some authority figure demands it you tell them to call me and I'll decide what happens. In almost all cases the answer is no, regardless of all factors.

I think the parents having the video would be the most disastrous thing for the school. This will spread online, or at least to that areas news channels for local coverage. I'm going to keep a eye open for it on other sites.

#1 - resource officer GONE

#2 - principal GONE

#3 - teachers who interfered with recording of abuse SUSPENDED

there is no justification for this heavy handedness, especially among young adults. Hope the school district gets sued into oblivion and kudoes to Mike for standing his ground.

Again, when Johnny Law decides to come on here and defend the cops and the school, what MOST abuse defenders fail to realize is this action does NOT help maintain control and order over the student body. It has an opposite and corrosive effect on the students being able to trust and confide in authority.

Unfortunately the system getting sued really means that the tax payers get fleeced and the people responsible are not held financially responsible for their actions. Is is any wonder things are as they are?

The school violated his due process right in suspending him.
To suspend a student the school must follow it's written policy.
The student must have an opportunity to tell their side of the story. Which did not happen.
The principal should have know this and he did not follow the school procedure, there by denying this students right to a education. He would get a nasty letter in his file.
Since this incident is more public, expect more nastness

They used to arrest people in PA, which has about the same disordly persons law, for telling cops to go fuck themselves. But not anymore. So I doubt it's going to survive in NH.

Also saying what he said is not "likely to provoke a violent reaction on the part of an ordinary person". Now maybe a hyper sensitive trained police dective is a different story. Someone like that with extensive training in dealing with adolessent boys would get violent at the drop of a hat. Or is just looking for a pre-text under which to commit an assult on a student. Yeah, that's more likely.

That why you don't talk to cops, many of them are looking for a pre-text to do something strange.

Boy I could write a book here.... First first of all the first amendment does not apply to the States it is an explicit restriction upon the federal government.

Your last statement makes no sense as free speech is not mala prohibita it is mala in se. In other words lawful as opposed to legal.

As far as the NH law about profanity - it may be legal but it is also mala prohibita, and now lawful or mala in se at all.

The supreme court does not give me my rights any more than the second amendment does. As far as my right to protect myself they are both irrelevant.

On a similar vein can you find in the Constitution where we authorized the supreme court to be an arbiter much less the sole arbiter of what is and what is not constitutional? (Hint: It's not there.)

The second however does prohibit the federal government from passing any guns laws - period. Again I repeat it has nothing to do with giving me any rights.

The bottom line is that the federal government is not the final arbiter of the federal governments power. If you investigate the above links you will be learning history that is purposely not taught in government schools.

I'm wondering why Detective Murphy isn't in jail.

Not a lawyer here. Since this was on school property, the school might actually be in the "legal" right to some degree on taping, as students from what I understand, may not have all their legal rights while at school (depends on the various state laws). However, the episode that was caught on tape, stands on its own, and the officer and school principal were clearly in the wrong (strike 1). The school teachers and principal having the student delete the files, speaks volumes - on destruction of evidence (strike 2). This whole episode will have legs. Talking back to the principal is an arrestable offense? I would seek a lawyer on the specifics.... and also go to the school board and ask why they have an out of control police officer and principal on campus.

It can't be that large of town/school where the principal did not know that they were brother and sister. The principal and officer just blew the whole thing out of all proportion. Is not their job to be the adults among the kids? That more than anything is why the two (and the other teachers) should go. Also, why does the 17 year old have to make bail (he can't sign a legally binding bail bond contract and probably did not have that kink of cash in his pocket) - parents should be notified. I think that the police department is in the wrong there. I would have a chat with the DA - and if no satisfaction there, then go to the State Attorney General about the out of control school, police department, and possibly the DA.

I am having a difficult time understanding how you can resist arrest when you are only informed that you are under arrest after being beaten into submission?

I don't think that legally requiring people to be at a place (truancy laws)where you take away their rights would hold up in just world. Also if your rights are truly inalienable that means that you can not even contract them away voluntarily.

If schools were really in the education business rather than the indoctrination business they would be very much behind the rights of their customers(inmates).

Looks like it is. A very good thing IMO

They are right that these kids do not understand their rights. None of our rights emanate from the Constitution as stated. That is not even close to what the Constitution is or does.
These kids would be much better off home schooled.
Instead the state mocks property ownership by extorting money to educate other people's children.

Good thing that this footage got on Cop Block though.....
