New Mexico Official to be Charged for Assaulting News Videographer

A New Mexico state employee assaulted a news videographer who was standing on public property attempting to document a breaking story involving skeletal remains.

KOB-TV cameraman Gadi Schwartz showed up to the Public Employees Retirement Association building in downtown Santa Fe last week, only to be ordered to leave the area by a state employee.

Schwartz, 27,  asserted his right to videotape on public property, which prompted the man - who was more than twice his age - to assault him.

The entire incident was caught on camera, but KOB-TV news director Julie Szulczewski chose not to air the incident - probably because Schwartz was openly mocking the employees' attempts to clamp down on his First Amendment rights, which might have not come across too well by its conservative viewers.

The video was obtained by the Santa Fe New Mexican, which uploaded it to its Youtube account. But earlier tonight, the video was made private.

I had the foresight of downloading the video to my computer when I had the chance, so now I've uploaded it to my own Youtube account. We'll see how long it takes KOB-TV's news director to try to get me to remove the video. I recommend everybody download the video.

New Mexico State Police, who viewed the video, said charges of assault and battery will be filed against the state employee, so there is clearly a news story here, even if Szulczewski failed to see that.

Meanwhile, investigators are trying to determine if the bones are even human.

The story Schwartz was working on involved the discovery Monday of bones by a construction crew working outside the PERA building. Pictures of the bones have been forwarded to the Office of the Medical Investigator and the state's Historic Preservation Division for identification.

Garcia said it is not clear if the bones are human remains.

I don't even understand why they escalate a situation over something so trivial. It's so stupid. Let him take his footage and let him leave. Bureaucrats man, they are such fuckin pieces of shit, they think they are god.

Nothing new, when I was in high school( 1958) and freelancing, now and then, for a small weekly, I was punched by a jerk just like this one. Went up side his head with a Speed Graphic. They did not call them the "combat graphic" for nothing! Turn it on its side and hit with the base plate, normally there will be no harm ( to he camera, that is). This was one of the reasons it was so popular for so long.

I can say there has been no real change, the asses are still with us.

I don't understand why KOB did not air this video and stand-up for the rights their videographer to document something that seemed clearly to be on public property in an area with no expectation of privacy. KOB should have shown the video and explained the rights of the reporter to document what was happening. It is sad when the media does not stand up to the State in defending our Constitutional rights.

Unlike other videos in which officers of the law enforce laws that do not exist or ignore ones that do, this one was merely an altercation with a violent state official and a stupid security guard. I can only assume that, due to the fact that the video cuts off before the police arrive, the police showed up and told those two clowns to take a hike. After all, the cameraman stood his ground, and the state official is being charged with assault; that seems like a fairly decent outcome to me.

A good example of how to stand your ground when wrongfully ordered to leave public property. Though I don't understand Carlos' attack on conservatives, who tend to be staunch defenders of the constitution.

I do. Just another crappy employer that won't back their employees if it's even the least bit inconvenient for them to do so.

What's with the shot at conservatives not caring about the 1st amendment Carlos? You have plenty of conservative readers, myself included, that staunchly defend their constitutional rights, and the rights of others.

I think you have a distorted view of what a conservative is.

I consider myself very conservative and I support free speech for everyone, not just people I agree with.

Carlos was the swipe at conservatives really needed? I am a conservative and I care deeply about free speech for everyone, so do all the conservatives I associate with.

The agency here invests public workers' retirement funds and has lost millions, much of it to Madoff and has a lot to hide. Hence the frowning on journalists and photography. The ERA or educational retirement board is also in a lot of trouble. I'm sure there are more "skeletons" to be found around Santa Fe. Around here the city is known as Santa Flush, as that's where wokers' retirement and tax money goes: down the drain.

Carlos, you have really good instincts. What made you sniff out that the video was going to be switched to private?

We must recover the element of quality in our traditional pursuit of equality. We must not, in opening our schools to everyone, confuse the idea that all should have equal chance with the notion that all have equal endowments.
