NYPD cop guilty in body-checking Critical Mass incident caught on video
Had it not been for a citizen armed with a video camera, it would have been bicyclist Christopher Long facing criminal charges.
Instead, it was former New York City Police Officer Patrick Pogan, who was convicted Thursday for lying on a police report.
He is facing four years in prison.
Pogan, whose career as an NYPD officer lasted only 11 days after he was caught on video assaulting Long during a Critical Mass bike ride through Times Square in 2008, was acquitted of assault.
He was found guilty of one count of offering a false instrument for filing, according to The New York Times.

Not guilty of assault & battery or anything of that sort? He is only guilty of writing a lie in a report? He got away easy.
The charge he was convicted of carries a stronger sentence than the assault charge for he was acquitted
Wow. What the hell is going on in this country right now?? First we make the first real move toward sustainable energy by approving the first off shore wind farm, and now police officers are actually getting convicted for their illegal actions. I just hope that this conviction is heard all over and begins to set a standard for what should happen to the increasingly Orwellian cops.
As for not being held guilty for the real crime, well it’s hard to expect that much from the case, so I’m not all that surprised.
Fingers crossed for justice. It’s a long shot, I know.
Even so, he should have still been found guilty of both charges. A deal must have been made to acquit him of that.
I hope he gets ass raped every day, he deserves it.

It amazes me that in America, everybody, even Federal prosecutors, feels free to publicly make jokes about prison rape.
What should be a national embarrassment is instead a national punch line.
It is criminal that people in our custody are routinely sexually tortured, and we do nothing but laugh about it. Among First World industrialized democracies, we have by far the most violently barbaric prison system. And we think it’s funny.
Of course. A conviction of assault or battery would have been a hell of a lot more bad press, while the lying conviction is something that everyone knows they do anyway so there’s no real surprise there.

Nate, prison rape happens all over the world, not just in the USA. I disagree that our prison system is the most barbaric in the world. In other countries body parts are routinely amputated, or kids that spit on the sidewalk are caned. In our system, you might get a beating by one of the guards, but that’s preferable to forced amputation (at least to me).
I actually prefer this charge over the assault charge especially since it carries a harsher sentence.

He was convicted I don’t think he will spend anytime behind bars. Our jails are already filled with Nonviolent drug offenders and People who have been found in contempt of cop. Sorry folks I really doubt that he will do any time.
I liked the defense in this case. It was essentially, “Here we have a sworn police officer, trained and has taken an oath. Are you going to believe this police officer or your lying eyes.”
He’ll do six months tops and be on probation. He’ll probably end up as a security guard somewhere and do the same thing to someone else.

My comment was not a joke Nate K, maybe we’ll all get lucky and he’ll get shanked. If Dick Cheny was sent to jail would you wish the best for him? How about a child rapist? Adolf Hitler? This man is a prick, an asshole, someone who used power granted to him by so called citizens to abuse us, as far as I am concerned he deserves to be abused since he has abused others. Would he have gassed us if his superiors asked him to? Would he throw us in a trench and shoot us if ordered to? Would he rape someone if he knew he could get away with it? I tend to think, yes, he would. I know these are very strong assumptions but that is the way of the world now, the way of the police officer, should we accept it? Should I bow down to my master? I don’t think so. So fuck this asshole, I hope his time in prison is a living hell because he fucking deserves it.

Thank God for the video. It is hard to know how many cops are like this. It certainly feels like this sort of cover up attempt is more the norm. Cops are given too much power.
I just can’t believe the amazing, overwhelming, preponderance of crooked cops. I am supportive of LEO too, give to LEO charity and such. But what the hell, these guys are assholes.
9/11 and the patriot act and our culture of fear have really skewed peoples ideas of law, it’s enforcement, and how to react. Police are no longer taught guile, wit, conversational skills. They’re just told to “taser” away as SOP. Hogwash.

@Rance The US has the highest rate of incarceration in the world. Last year it passed 1 in 100, and is now down to 1 in 98. For males between 20 and 30 it is 1 in 36. The rest of the top 10 are all former Soviet block countries and the closest of them is about 1 in 300. The rest of the western world (UK, France, Italy, Spain, Canada, Germany) is about 1 in a 1000. The US has 10 times the incarceration rate of rest of the western world. So while prison rape does happen all over the world, the US has greater share of it that most. It is also seems to be the only country in the G8 that takes pride in bragging about it as some sort of “extra punishment” for the prisoners. And that is what Nate is objecting to (as do I). Prison rape is not something that is to be desired, and prison officials should be doing their utmost to control it. There is something fundamentally wrong with the morals of a society that condones sexual assault in any way.

I’ll bet that the jury didn’t convict under the assault charge becasue the Jury Instructions required them to make a finding that the push was not done under color of law (ie: as part of his actions as a cop), and they weren’t able to agree that the cop didn’t do it under his authority as a police officer.

I don’t condone prison rape either Tom, or Nate. I was making a pun in regards to Jody’s comment. I don’t give a crap about statistics because I’ve done time outside of the US.
I lived in Indonesia for several years, and for most crimes committed there, the punishment is far too severe. The US prison system is a walk in the park by comparison in the “Nanny State” that we live in today. Unless you’ve lived it personally, like I have (prison, not rape), I don’t care what your research on Google tells you. I was arrested in Indonesia and charged with having porn on my cell phone (it was a topless pic of my girlfriend). I was facing 4 years, but my attorney got my sentence reduced to 1 year for an exorbitant fee. In Indonesia, you can’t trust anyone, not even your lawyer. I’d rather spend time in an air conditioned U.S. prison, with my own bed, soap, real food, and water that doesn’t give you the shits any day of the week.
If my sense of humor offends Nate, or anyone else here, they can get over it because I don’t give a crap about that either.
Clearly this man is innocent and this is simply the act of an activist liberal judge! Grrrrr.

I consider jury instructions as unfairly influencing the jury. Assault is assault. They failed as jurors while pretending to be lawyers. Trial by jury is an open invitation to wield your common sense as a citizen. The law exists to right wrongs. The nuance of law is never an end in itself.

Virtually all cops are felons. Those that witnessed this incident and failed to arrest the guy, those that supported his lying report, those that attempted to cover for him, all are accomplices and accessories to the crime and should all spend time in prison.
This case proves exactly why and how photography is not a crime in this country, regardless of stop and search / detains going on around the country for people with cameras.
You bet your sweet ass that the NYPD directly affiliated with this incident will be arresting more photographers now that one of their boys has been figuratively boned by a rogue cameraman.
Bikes are legal. Protests are legal. Peaceful gatherings are legal. Photography is legal. Yet somehow, this guy is only looking at 4 years… and what about the guy on the bicycle with the google 360 degree camera that got harassed? or that girl that took a picture and walked away and they arrested her too for not showing ID? all at the same incident if i recall correctly.

#1: Did the supervisor admit to saying this? #2: Even if the supervisor did say this, I don’t think it is that bad. It isn’t unheard of for a supervisor to tell officers to “do whatever it takes” to enforce traffic laws due to citizen complaints, etc.. I don’t think we should paint 100% of the beat cops as so stupid, that supervisors _must_ add “under color of law” or “within lawful purposes.” These folks should be learning about lawful use of force, etc. within the first week of being hired.
I’ve been following that case fairly close and I am very worried about the chance for a conviction in the case. Grant’s own friends gave statements that seem to back the defense.

“And Pogan’s dad told WCBS 2, ‘For them to make a decision like that that, to have someone’s life in your hands? It’s tough but that’s what police officers do in seconds and they had eight hours to think about it. My son had seconds to think about what he had to do to make that arrest.’”
Yeah, Dad Pogan, your thug son only had seconds to decide which cyclist to tackle and beat down before they rolled by.

The truth of the matter is the police have had a long time to think about it too. The police have had many DECADES to decide how they are going to handle certain situations and develop TRAINING PROGRAMS to help their officers do their jobs and stay within the limits of their authority. Pogan was not just stuffed into a police uniform and shoved out onto the street. Sorry Pop, your kid was not some innocent Boy Scout here.
The cops think they’re above the law, and the courts are more than willing to stand up for them. I’m so sick of “The Thin Blue Whine” it makes me want to puke!

Well, we’ve managed to get right down into the gutter here.
A citizen doing this to a cop would get severe punishment, but if a cop attacks a citizen, he get a slap on the wrist. “Law enforcement” personnel should get double the punishment for breaking the law.
The truth is those thugs (cops) are working for the government, and this is why the law protects them. I recommend people to read “The Law” by Frederic Bastiat.
