NYPD cop threatens citizen with jail and rape for being "disrespectful" (video)



An undercover New York City police officer threatened to throw a man in jail for being “disrespectful,” then proceeded to tell him he would get brutally raped over a three-day stay while waiting to see the judge.

The cop had no qualms about saying this in front of a video camera.

The incident took place last Friday in a collective art space in Brooklyn that was being raided, apparently for running “an illegal social club,” according to the Glass Bead Collective, which posted the video on its Youtube channel.

The Glass Bead Collective, a group of independent filmmakers, has been mentioned on Photography is Not a Crime for its activism videos.

Police also sprayed several rooms with pepper spray during the raid.

The citizen videotaping the cop erred in telling the cop that he had no right to videotape the citizens. It works both ways.

A civil rights attorney told Gothamist that the cop may not have broken the law but most likely broke departmental policy.

Wylie Stecklow, a civil rights attorney representing Teichberg and the Glass Bead Collective, tells us that while it’s unclear if laws are being broken, “policies are being broken. I believe the officer can be investigated for misconduct. There needs to be a CCRB investigation, because this officer was clearly being discourteous. Telling a videographer he would be abused in prison and be arrested when he’s not breaking any laws… This seems to me to be—while not necessarily illegal—certainly not within the bounds of the Courtesy, Professionalism, and Respect that the NYPD has promised his citizens. That the same office tells another female over and over that she is ugly, that is incredibly is discourteous.”

The sad thing is that the cop could realistically, if not legally, throw the person in jail for any reason he cared to invent.

The fact that he knew he was being recorded may be the only reason he didn’t.

Interfering with an officer. You can film him but don’t badger him. This business about a cop not being able to use a camera unless there is a crime actually in progress really sounds bogus to me.

Of course we know Cops lie and threaten people all the time. So what else is new. It’s the “same old.. same old” story.

They wear the shield, carry the gun and go about trying to force people to do their will just because they are who they are.

1.) I will also ask: what is a illegal social club? What is so illegal about it that warrants police raids with teargas and cops with penchants for prison rape…?

2.) If you run into a cop (say at a donut shop) and tell him, “If you persist in looking at me that way I am going to see to it that you are brutally raped.” I guarantee that you will not only end up in jail and charged with assault but you will also suffer a beating at the hands of everyone’s favorite civil rights violators.

The crap about getting raped was pretty unprofessional. I think the camera person just got on his nerves too much by following him around. Of course that doesn’t excuse saying it.

I do think it was funny that he took out his iphone and started videotaping the other person right back.

I’ve dealt with annoying folks like this before. If you just ignore them, they usually realize you aren’t going to give them a show and they leave. However if you react like this officer, it just encourages them to stand around with that camera and yap like a chihuahua.

They’ve also done a pretty outstanding job documenting NYPD harassment of Critical Mass bike rides. This is a video of a police officer issuing a summons to a street preacher whose speech I disagree with. The officer was issuing a summons for noise violations. IS it free speech that is not the point here. HE can dispute that in court. He may even win. I offer this as a example.
This officer is NOT afraid of any camera or being video taped. He does his job professionally. He has honor and integrity he knows the law, properly tells them that they can dispute it in court, gives his badge number. HE takes control of the situation calmly and with integrity because he is a HONEST and HONORABLE officer. HE has NO fear of any camera.

The person threatened by the cop should sue the cop and the City. The Cop’s threats violated his oath to uphold the law; he should be fired; the cop threatened the Citizen with cruel and unusual punishment violating the Citizen’s Constitutional rights. Cops could use the same threats to make people inform or confess to crimes they did not commit.

The cop’s crass threat of rape was way out of line. The threat of jail has some merits to it, considering what was taking place. He should get a serious ass chewing from the top and maybe even some documented disciplinary action. If he was undercover, he probably had some rank, which makes his screw up even more stupid.

We sometimes have video cameras out on the street during big events. This is to document the size of the crowd and to be able to refute any bogus complaints. We always have someone come up and start whining about Big Brother watching them.

The Lieutenant should not have answered any questions on film and referred the guy to the media relations ofc. That’s what I on the few occasions people tried filming me while asking me qwuestions. Our policy prohibited us from conducting interviews without permission.

I am a little confused about the preacher video. The officer says he is going to issue a summons but that the preacher is not breaking the law. Maybe it is just the terminology that is confusing me (just like the preacher) but it sounds like the preacher is violating some local noise ordinance which would be a law.

In my area if we issue a citation for something and that doesn’t stop the behavior (such as noise ordinance) we make an arrest. I don’t see the point in tossing multiple citations at the guy if he is going to keep on with his actions.

I did like the way the officer interacted with the guy. Great demeanor.

The Difference in the law from state to state aside

I was impressed by the fact that because he knew he was a good cop, he had no problem being filmed. There are other better examples of police officers protecting peoples rights. Doing it with respect for the public they serve. With no fear of cameras or video.
Oh im being filmed NO problem but you are going to have to do this or that because you are not in compliance with the law. Thank you very much.
However the guy above in Carlos example was the poster boy for eventual disrespect for law enforcement as a whole. His action was contempt for the public he served and the seeds he sowed will be further contempt for the police that will be thrown ON some poor cop down the line.
In my business ,we police ourselves to create better craftsmen. The police protect guys like this and there Profession as a whole loses respect.

One point that I haven’t seen addressed here is that the NYPD patrol manual explicitly states that an officer is to courteously give his name and badge number upon request. (Unfortunately I can’t find the PDF at the moment.)

When that cop refused to give his name and badge number, he was violating Department policy.

Now, while it might seem like a rather trivial issue to refuse to give that information, it’s anything but. Just see what an airport security guard says when you claim it’s no big deal if you don’t want to hand over your ID. Identifiability is crucial, in that it ensures accountability; if that person has done or does something wrong, you have a name and a badge number to pin it onto. Otherwise, in practical terms, there is very little one can do to hold that person accountable.

Sir Robert Peel established back in the 1800s that police should even have badge numbers to insure accountability for their actions… covering just the sort of clownshoe we see in the video above.

Apparently guys like this go back a ways.

Johnny Law: A cop has the real ability to haul someone in and hold them entirely on their own say-so. A credible threat to use power that one actually possesses, coupled with the threat of jail-rape, is not just rudeness. It’s criminal. True, the cop in this video was a disgrace to the badge, but I’d never wish death on anyone, especially police officers. That’s what Officer “Paul Simon” needs to be prosecuted for.

This crap is spreading, but I think it’s business as usual and only the growing ability for citizens to record and disseminate these occurrences make them appear more common. But other cops must have known this has been going on. And none of them have shown the courage and/or integrity to stand up and do something about it.

Think about how common these videos are becoming and ask yourself this: are incidents where cops bust other cops for breaking the law just as common? If not, then it’s not just “a few bad apples” making cops look bad — it’s a few good apples surrounded by corruption.

And if that’s the case, then most cops in any given sample *are* the bad apples. Have you and Oscar ever reigned in a bad apple?

The prosecutor could start by looking at 18 USC 242 and working down from there.

Note that if 18 USC 242 applies under attempted infringement (it certainly does when the infringement is sucessful), the cop in question could face the death penalty.

M.A., “aggrivated assault” is one of the charges likely to apply to the cop in this case, in particular because a reasonable person can very well believe this cop could drag the videographer to jail without legal cause and therefore be a potential accessory to rape.

Aggrivated Assault is usually a felony charge.

@Carlos, after speaking with the person that recorded this video about when he said the officer had no right to film them, I realized he was referring to the “Handschu Agreement”.

Quoted from Wikipedia, it states:
“According to the terms of the agreement, purely political activity can only be investigated by the Public Security Section (PSS) of the NYPD’s Intelligence Division, and then only when the Section suspects criminal activity. When the PSS does suspect criminal activity on the part of political groups, it must obtain a warrant from the three-person Handschu Authority, a commission made up of two deputy commissioners and a mayor-appointed civilian.

The agreement also prohibits indiscriminate police videorecording and photographing of public gatherings when there is no indication that unlawful activity is occurring.

The department is also prohibited from sharing information pertaining to political activity with other law enforcement agencies unless those agencies agree to abide by the terms of the Handschu agreement.

The court order mandates the compiling of annual, publicly-available reports listing the surveillance requests made by the NYPD and the number of such requests granted.”

The GWC here is obviously mistaken in his interpretation of Handschu. If he were to file a complaint against the officer for violating that agreement, he would have to be able to prove that his filming of the cop was done for purely political reasons, which we know to be a load of crap.

While we know he was wrong, it is blatantly obvious that the undercover was as well. Thought I would throw that out there so you had an idea about what he was talking about.
