NYPD cops charged with rape after caught on surveillance video
They may have never been charged with rape had it not been for the video surveillance camera.
After all, who doesn’t believe a police officer?
But the video became one of the strongest pieces of evidence against two New York City Police officers who have been charged with raping a 27-year-old drunk woman who was passed out on her bed after vomiting several times.
The officers, Kenneth Moreno and Franklin Mata, had helped the woman into her East Village apartment in December after receiving a call from a cab driver saying she was unable to pay the fare.
After escorting her inside her apartment, the officers returned twice in that same evening, including one time after they allegedly placed a false call to dispatch from a public phone in order to justify their return to the building.
it was the third time when Officer Moreno allegedly raped the woman as she laid face down on her bed. Officer Mata stood guard outside the door of the apartment as the rape took place, prosecutors told the New York Post.
Surveillance video captured them shielding their faces from a camera they spotted on the second trip. The two didn’t realize a separate camera caught their attempts to conceal their identities.
Their actions that night and during the following days — when they allegedly faked logbook entries — prompted prosecutors to build cases against both officers and eventually to reject a purported offer by Mata to testify against his partner.
Investigators also found heroin in Moreno’s locker, adding to his stellar reputation as a police officer.
The officers, who have pleaded not guilty, insist the sex was consensual, even though the woman’s blood alcohol content was between .20 and .33, according to Newsday.
Besides the videotape, investigators have also obtained an audiotape of a conversation between Moreno and the victim after the alleged incident where he apologized, according to the Post.
Wired with a hidden device, she arranged a meeting with Moreno, who apologized to her for his actions that night and conceded that she had been extremely intoxicated, sources said.
The probe involved numerous forensic tests at the woman’s apartment and interviews with virtually everyone who came in contact with the cops and her, including cabby Kofi Owusu, who took her home, residents in her building, and the two drivers involved in the accident.
The officers have been charged with rape, burglary and official misconduct.

They’ll probably just get probation. I mean, they’re “troops” fighting a “war”.
Disgusting. Absolutely terrible. And they’d have gotten away with it too, were it not for the cameras.
Eric is not kidding. If it weren’t for this supporting evidence the legendary egandary NYPD slander and intimidation “dirty up the victim” scheme would destroy this woman.
How are the LEOs going to explain this one away?
Going to arrest her and accuse her of ‘not following a lawful order’? Will the scream and yell that eventually we’ll need a police officer and how dare we treat them like THEY are the criminals? Will they say that this woman was actually assaulting the officers in question? Will they say that we weren’t there and the video tape only tells part of the tale?
It is not because of the blazing hypocrisy that police are sliding down the slope of respectability in this country, although that IS a factor, it is the fact that they will not distance themselves from the dirty cops who make the rest of them look awful.
Scum is scum, LEOs, no matter if it wears a badge or not. Let the bastards, these and other who think they are above the law, burn.
…and lemme guess, they’re suspended WITH pay until the outcome?
On another board, a cop made this comment connecting the NYPD with Jesus. Yes, Jesus. You just can’t make this up: “These Policemen could no have committed this crime than Jesus could have. I suggest we give them the benefit of the doubt. I would take the word over a NYC police officer than I would the word of a stinkin’, snivelling little “professional” c*unt any day of the week – A DRUNK AS A MATTER OF FACT.”
Not only are they rapists, they have no respect for truth and honesty.
jones is surprisingly silent.
Watch out for the cameras watching the watchmen, ladies and gentlemen!
Interesting debate on this topic going on at this site:
http://www.feministe.us/blog/archives/2009/03/03/nypd-accused-of-raping-...
where idiot police apologists get—no pun intended—clubbed.
Here an excerpt:
if you and your son want to reap the benefits of being (or being related to) a cop, they YOU and YOUR SON need to start calling these “unconvincted”* violent criminals out and holding them accountable for their crimes. When was the last time your son reported a 9th precinct fellow for abuse, AND cooperated with IA? I’m guessing never. Has he, personally, or you, personally, EVER held a criminal-disguised-as-a-cop accountable for behavior like this? Or do you just hide behind the Thin Blue Whine of “it’s a haaaaaaaaaaaaaaard job, so we should get away with whatever we want!” From your posts, I gather its the latter, in which case, my sympathy, it is lacking.
If the good cops want to get back to the days when people trusted cops, and didn’t just see them as the paid criminal arm of the government, then the good cops need to stop hiding the bad ones, stop making silly excuses like you are doing now, stop whining about how hard their job is so that pressure simply MUST give cops the right to act like the criminals they supposedly chase, and start holding them accountable for their thuggery. If the self-proclaimed “good cops” can’t or won’t do so, then they are 1) not actually good and 2) have nobody but themselves to blame for their troubles with the public.
Fixing the problem of police criminality, restoring honor to the force, is entirely within the power of the good cops. Too bad you and your son and the rest of the force can’t be bothered to hold violent criminals responsible, if those violent criminals happened to wear a cop uniform.
*scare quotes because animals like that are NEVER convicted, due in large part to attitudes like yours
“It’s too bad that some of you can’t call each other instead of 911 when your life is in danger”
After a whole post of whinging about how hard police have it and how we should assume they’re innocent, the truth comes out. After all, us civilians ought to be thankful that the police are there to help us. If only we knew what life would be like without our glorious protectors, if only we had the proper respect for our glorified meter maids and enforcers of public morality. And there in the background, behind all the self pity and guilt trips, a veiled threat. “We might not always be there, you know, or we might not be there for you…maybe you should call each other if you dislike us so much…”
“I know that you can provoke a bad reaction when you question the authority of SOME officers”
The “some bad apples” argument fails for one simple reason: whenever a cop does something wrong his fellow officers are expected to back his play, cover his ass, and do whatever is necessary for their brother. You’re taught to in the academy, you learn it from the culture, and if somehow you manage to retain some shred of human decency after your first few years in a rough precinct (because, hey, how better to get you thinking in terms of us-versus-them?) you know what happens to cops who become “rats.” Accessory after the fact is a way of life for police, which makes them all guilty.
More concerned, highly intelligent comments from the fine members of the policing community can be found here. http://www.nydailynews.com/forums/thread.jspa?threadID=52094&start=0&tst...
My personal favorite is the one by POLICE POWER who states that these cops are innocent because if they were guilty they would be in jail already; it’s been three months. Yes. This makes perfect sense. Investigations should only take 3 months! Thank You, POLICE POWER. His good buddy “LOVER” (who seems to have inside info on the case) gives us the victims, uh I mean perpetrator who was “feeling the alcohol earlier, but was not that drunk later on” and who is “just f..king with everyone and ruining a good man’s lifes” initials. Her initials–just what we needed to get to the truth. “Lover” is apparently very generous. Last but not least, an honorable mention goes to the poster who reminds us that “99% are out their doing their jobs to protect your rights. And when they get hurt or killed doing so no one except their families and another cop grives.” Yes, officer, you are correct, as usual. Who the hell cares about that insignificant 1% of bad apples when cops are out there dying! Dying! Somebody get me a Kleenex, and fast.
Don’t you just love cop logic? I do. There’s nothing else quite like it. It’s the perfect mix of aggression, stupidity and 1 + 1 = whatever the hell I want it to because I have an IQ of 55 and a badge I got outta a cracker jack box. And the funniest part is: they actually believe their own lies. As if stating a lie, opinion, or half truth with that characteristic smug cocky confidence makes it true.
The infamous New York transit cop who robbed banks was also in the news yesterday. He was sentenced to 10 years in prison for the bank robbery in Pennsylvania (story in the Reading Eagle) Sentencing for other banks he robbed in New York is pending…
“they have no respect for truth and honesty”
They’re called pigs for a reason. The so called good cops who would not? do something like this either remain silent or cast dispersions on the reputation of the wronged. Was it foolish to drink too much? Many would agree it was. Far worse though is an individual who would capitalize on the weakness (or poor choice) of another. How is that different then the criminal who robs the frail old lady since she’s an easy target? Or those that take advantage of the too trusting or mentally ill? They are predators. That’s the criminals mindset. It’s also the cops.
I thought we stopped blaming victims a long time ago.
So jones, comrade or criminal? Or are these two just plain creeps?
Speaking of rapist cops what about Gerard John Schaefer, the Florida cop suspected in twenty-nine murders. He liked to play the victim. This link isn’t for everyone

Talking about rapist cops, let’s not forget the Haitian man who was sodomized by good’ol officer Volpe, while 3 other cops held him down. Their guilt was proved beyong doubt. That’s my response to whoever says that the cops could NEVER had raped that girl. Think twice.
And remember the cops did that in a crowded police station. Not one person stoppped them or even bothered to ask what they were doing. Volpe did an interview with the NY Post? where he said he felt like he’s the victim. Unbelievable.
Hey, its dick heads like this that make me look so good. The other day I was 10 minutes late for work because I pulled over my car to help a stranded motorists and my Sgt. broke my nuts. All I had to do was point to this news paper article and he shut up!
You're a NY City cop? You're a FUCKING PIG just like the rest of them. Not one of you mother fuckers is on the up and up.
A few bad apples spoil the barrel, if you let them. And they’re letting them.
