NYPD Handcuff Videographer In Times Square For Recording Arrest

New York City police officers handcuffed a videographer after he refused to show them identification early Saturday morning.

Felix Maurent, who was wearing a National Press Photographers Association badge around his neck, was videotaping an arrest.

His video shows an NYPD officer ordering him to leave the area, accusing him of obstructing foot traffic, even though it was obvious he wasn’t obstructing anything.

The officer then demanded his identification, but Maurent stated he was under no legal obligation to do so. And he was right.

The cop walks away and the video ends.

A minute later – after Maurent had turned off his camera – the officers stormed up and handcuffed him because he had not shown them identification.

“He comes back and says if you won’t show me your ID, I’m going to take you to jail,” Maurent said Sunday afternoon in a phone interview with Photography is Not a Crime.

Another man with a video camera captured a clip of Maurent with handcuffs. Maurent can be heard complaining of an unlawful arrest with a camera and NPPA press badge around his neck.

That video is below.

Maurent said he was released ten minutes later. He said he filed a complaint with the NYC Civilian Complaint Review Board and will be talking to attorneys.

“They had no right to handcuff me,” he said.

Piggy waited until the camera was off, the proceeded with the false arrest knowing that he wouldn't be recorded.

Too bad the "cop's" thought process is so addled ( to the point of being declared legally retarded ) by 'roids he thought the victim was the only one in NYC with a camera.

This is what I was talking about in the previous post about the Kansas City incident. This photog is hitting back. Thousands of cops will read multiple stories in the press re false arrests, 1A/4A/5A rights, damages paid, extra training given to the officer/s etc, etc. You think this cop won't get razzed in the locker room about getting spanked (trained/diciplined)? You think any other cop will want to take the chance of getting a similar spanking by the system? This lesson will be remembered for a good while. Good on ya Mr Laurent.

At most he'll get a week or two of paid vacation and the court award will be paid by the taxpayers. Do you realize that NYC budgets about $40 million each year to pay off lawsuits?

This won't end until qualified immunity is removed from law enforcement and the next cop who pulls this stunt loses his house and his family gets kicked to the curb.

I have a feeling that police officers are no longer being taught that they need "reasonable suspicion" to detain a person and demand ID. They have been trained to demand ID from anyone on the street who catches their attention, and to threaten arrest for failure to comply. In fact, I would be very surprised if any police officer on the street is able to articulate the difference between "unusual" and "suspicious."

Under the NY stop and identify statute, an officer may only detain a person and demand ID if he has reasonable suspicion. Reasonable suspicion requires "specific and articulable facts" to justify the stop. (Terry v. Ohio) This violation of the 4th Amendment (a Terry stop NOT based on reasonable suspicion) has no consequences to the average officer on the street because it's far too easy to write up a police report after the fact and cite "furtive movements" or "bulge in suspect's pocket" as the reason for the stop. So the default is now to demand ID from everyone, and god help them if they fail to comply.

If I am wrong, and anyone here has institutional knowledge about NYPD training practices, please correct me.

Looks like you have summed it up nicely. The thugs armed with 'roids, rage, guns, and badges have made another illegal arrest caught on tape. New York tax payers will pay the settlement. The city will admit no guild as part of the settlement. The testicles of New York's "finest" will continue to shrivel and die. And the Constitution will continue to be totally ignored.

NEVER talk to the police.

If you are not driving (or trying to get on a plane) you are NOT required to carry ID.
You may be required to identify yourself verbally (the mentioned 'Terry' stop).
Remember 'Am I legally required to comply?' 'Am I free to go?'

Your story is incorrect re: the photographer being right about not having to show ID.

Look up "stop and identify" statutes....New York is one of 24 states that have this law on the books and the SCOTUS ruled in 2004 in Hibbel v. 6th District Court of Nevada that it was not a violation of the 4th Amendment.

This sort of statute will likely spread to the other 26 states before long....

Face it: the 4th Amendment is dead and the Amerikan people don't really care.

Although my reply does not pertain to the story,reading the story reminded me of a story I read in Playboy mag forty years ago.

The police were building a new police station in a town in England. When the new beautiful building opened the police asked to have the name of the street to be changed. The town turned down the request because the street has had the same name since the late 1500s. The name of the street is Pig Lane.

I have to get something off my chest. I’m sick and damn tired of coming to websites like this, which I highly support and getting fucking pop ups and advertisements asking me if I want to be a damn cop. To all the advertisers our there or Google or whoever you are NO I don’t want to be a Nazi.
