Protester Shoots Cop "A Look," Cop Punches Him In Face (Video)
Tensions continue to mount at Occupation Wall Street
A white-shirted NYPD supervisor was caught on video punching a protester in the face Friday without apparent cause.
Well, the protester did admit shooting him a look.
Whatever that look was, it prompted Deputy Inspector Johnny Cardona to grab him by his shoulders, spin him around and punch him hard in the face.
Felix Rivera-Pitre, the protester, said the officer ended up ripping his earring out, causing blood to spill out. He also happens to be HIV-positive.
According to Gothamist:
Rivera-Pitre, who is HIV positive and used to be a dancer, tells us he was walking a little bit in front of the police on William Street, and admits he "shot the cop a look." But then, according to Rivera-Pitre (and this is in line with what we witnessed), "The cop just lunged at me full throttle and hit me on the left side of my face. It tore my earring out. I remember seeing my earring on the ground next to me and it was full of blood. I was completely dumbstruck. I'm HIV positive and that cop should get tested."
Asked how he escaped, Rivera-Pitre says, "The cops were pulling me by my feet and the crowd was pulling me by my hands, and I was suspended in the air. But there were more people than cops, and they pulled me out." The police were seen searching for Rivera-Pitre in the crowd, but somehow he managed to slip away.
Even though Rivera-Pitre got away, police want to charge him with attempted assault on a police officer, obstructing governmental justice, resisting arrest and disorderly conduct.
Police claim he tried to elbow the cop in the face, but at least three videos show that wasn't the case. And considering that almost everybody seemed to have a camera, there are surely many more videos out there.
Rivera-Pitre has retained civil rights attorney Ron Kuby.
"On the off chance they were intending to arrest him for injuring the captain's fist with his jaw, I strongly suggest that you decide not to add insult to injury and avoid such a retaliatory move," Kuby wrote in a letter to the NYPD and Manhattan DA's office.

You got to love those ass clowns who try to over dramatize everything.
I have watched these videos repeatedly (specifically the point where Rivera-Pitre is punched), and I'm calling bullshit on your post. I watched all the angles shown, and Rivera-Pitre was clearly sucker punched. Cardona grabbed him by the shoulder, swung him around, and introduced his fist to Rivera-Pitre's face. Sure, Rivera-Pitre might have ignored an order from Cardona (which you CANNOT HEAR, and don't know whether that order was lawful or not).... Hell, he could have told Cardona to "get fucked", that is still no reason to sucker punch the guy.
I disagree with a lot of what these protestors are saying, but I also disagree with a lot of the actions taken by the police. This is one of those times when I vehemently disagree with the police.
A sucker punch is any punch where the opponent has little to no time to react. That doesn't necessarily mean a punch from behind. If you saw a fist flying towards your face, would you raise your arms to block? I sure as fuck know that I would, granted I was given enough time, which Rivera-Pitre obviously didn't since the blow landed square. Cardona had absolutely ZERO reason to punch this guy, regardless of his flippant attitude.
"Ran like a common criminal"? Give me a break dude. He got ASSAULTED by a thug hiding behind a tin badge. Once he was attacked, the storm troopers rushed to aid the attacker. Given the heat of the moment, I'm sure ANYONE would run just on instinct alone... That's called "Fight or flight" in case you haven't heard of it.
I'm no lawyer but in a way fight or flight is a sort of defense. Without mens rea a person cannot be held entirely liable for criminal actions. Unlike the officer here, He didn't have any opportunity to decide consciously that he would fight back and flee arrest (which he didn't really do because he didn't fight and nobody told him he was 'under arrest' from what we can see). Being an impulse reaction he couldn't be found to have knowingly and deliberately done anything like that. The only thing you could really argue is on the disobeying, which again is arguable that he could actually hear anything and even know he was the target of any request.
If I had been punched in the face by anyone, cop or not, I would not sit by and wait for some more. Why would anyone?

"Sucker punch" has a variety of acceptable definitions. Bad enough the cop lost his shit and punched the guy, worse that it was a bitch move where he snuck up behind and spun him around first. Don't whine about semantics, Boyce.
Rivera-Pitre has no reason to turn himself in. He didn't do anything wrong.

No need to get foul-mouthed about it. A more telling insult, for anyone who knows the least bit about history, would be to call him what he is. He's a Good American, in the same sense that many people were Good Germans 70-odd years ago.

Swinging, however, is not.
Flipping a cop the bird is protected speech. A mere facial expression is a much milder insult, even if it was a very dirty look.

Whatever you may think of the OWS movement, it has become a farce through infiltration of opposing and unrelated agents. That said, these poor shlubs are doing a FANTASTIC service to all of us by exposing the underlying intent of law enforcement around the country. Take notes.
Do the white shirted NYPD goons think they're being "true Americans" or something by smashing their fists into the faces of hippies? Is this a reasonable outcome of the See Something, Say Something facade which seems to extol some movie-grade analytic acumen to Joe Q. Loser? I don't know the answer.
But I do think that since LEOs hold the power of our lives in their hands - even when using the bullshit less-than-lethal products of TASER - their actions must be scrutinized even more. And the consequences for their misdeeds, higher. Like flogging. On YouTube.
