San Jose cops beat and tase handcuffed student on video


San Jose police were caught on a cell phone video viciously beating and tasering a 20-year-old unarmed college student, even after he was handcuffed.

While the video is difficult to see unless you enlarge it, the student’s screams of pain are chilling as he gets beaten at least ten times with a metal baton.

And the officer standing casually overseeing the torture indicates that Phuong Ho was not “violently kicking and refusing to comply” as stated in the police report.

The video is visible enough were several ex-police officers interviewed by the San Jose Mercury News believe excessive force was used. And three San Jose City Council members are demanding an investigation.

Fortunately, the San Jose Mercury News is making an issue about the incident, so far dedicating four articles, including an editorial that describes it as “the kind of thing you expect from rogue precincts in Los Angeles or New York.”

The editorial tends to believe the San Jose Police Department is getting out of hand:

San Jose police in recent years have made unusually high numbers of arrests on charges such as public drunkenness and resisting arrest — incidents that other cities tend to resolve without filing charges. Has confrontation become the norm here?

The four officers have been placed on leave, which means they are now sitting at home getting paid until this blows over. Or possibly sooner.

The incident started when Ho, a Vietnamese mathematics student who attends San Jose State University, got into an argument with his roommate, who slopped soap on his steak. What is it with college kids and their pranks?

Naturally this angered Ho who picked up a knife and said “In Vietnam, I would kill you for this” before putting the steak knife down. Some of the students laughed but the idiot who put soap on his steak, Jeremy Suftin, freaked out and called the cops.

Now I don’t know about you guys, but if somebody ruined my steak with soap, there is a good chance I would stuff the damn thing down his throat and make him buy me a new one. You don’t mess with a man’s food and not expect some kind of reaction.

When police confronted an unarmed Ho in the hallway of his apartment, they said they could not understand his English, so they pushed him aside and entered his residence – without a warrant – and proceeded to look for his identification.

And here is when the already de-escalated incident escalated to sadistic torture.

Unknowing to the police officers, the incident was recorded by other roommates who did not soap his steak.

You would think that with so many people carrying cell phone video cameras, officers would think twice about torturing people, then lying about it on their arrest reports.

Ho ended up being transported to a hospital where he was treated for taser burns and had to have staples to close several wounds, including a gash on his head.

I saw a news report earlier, and Ho speaks fluent English with only a slight accent. I daresay his English is better than that of many U.S. citizens.

I really couldn’t see anything on the video, but that report claimed he threatened the soap-slosher with an “18 inch butcher knife”.

Seriously. If any news reporter believes there is such a thing as an 18 inch kitchen knife, she’ll be really impressed with my 10.8″ penis.

Sorry, I spoke too soon. Now that I’ve watched the version of the video you posted, I can see clearly that one officer is waling away with the baton while Ho is “resisting” by trying to ward off the blows. And then when they stop hitting him long enough that he can actually comply with their demands to roll over and be cuffed (“not complying” being the justification for hitting him in the first place), there’s an officer sitting squarely on his back, he’s in handcuffs, and the officer with the baton whacks him squarely across the backs of his bare thighs.

Undisputably excessive, and abuse.

Fortunately the tone of the police chief is one that seems to suggest he is legitimately concerned about this kind of behavior and will punish it, rather than most police departments where leadership is only interested in how quickly they can sweep it under the rug.

The video isn’t that great but the sound quality is excellent. I found myself wincing every time I heard that baton strike flesh.

I think the real lesson of this story is to do what the police tell you when you are getting arrested. You can hear the officers giving very loud and clear commands but the subject would not comply. If you want to argue your arrest, do it in the courthouse, not in the kitchen. The police will win that one every time because it is our job.

Sorry Johnny you are, as usual, wrong. I do not have a legal duty to do whatever you tell me. You do not have the legal authority to do whatever you want.

False arrest and false imprisonment are certainly two causes of action that a person can collect on, but why not shoot for the whole boat, take the hit, and collect.

Of course, here, we don’t see that. Here, we just have a garden variety abuse of power which probably followed after a contempt of cop situation. Still, the sound of metal on flesh is sure to sway the jury; I’m still thinking payday.

It makes me sick. Especially when the 1 cop mentions that he didn’t get a chance to hit this kid yet, so they back up and let him get a shot at the kid. It’s like they’re just beating him just to kill time.

Then at one point they were telling him to roll over. So he did… but he didn’t understand what they REALLY meant, so he rolled all the way over, not half way. BAM, they wacked him some more. WTF???

Who were the PROTECTING here? Who was being SERVED?

Perhaps you missed the part where the police were called over because the suspect threatened someone with a knife? I don’t know where you live but in my jurisdiction that is a serious felony.

So the police have to arrest him but he obviously doesn’t want to go to jail. I am curious what you want the police to do in this case. Maybe they should beg him to pretty please come along. What happens when he refuses then?

The problem with the people on this site is they want to the police to protect them without actually having to put their hands on people. Erin, you actually do have to COMPLY with the police when they try to arrest you. It doesn’t matter if you agree or not. You don’t have the right to resist arrest.

If people had the right to fight the cops whenever they didn’t agree with the charges, there would be total chaos out there. It is like driving off if you don’t agree with the traffic ticket. To think otherwise is incredibly naive.
