TSA Speedo Stripper Strikes Again

This time, he is permanently banned from Jetblue

A college student named Jon who has been entering Transportation Security Administration checkpoints stripped down to nothing but Speedos was permanently banned from Jetblue when he attempted to do the same in JFK International Airport in New York City.

On Wednesday (or Monday depending which date in the video you believe), the student stripped down and was immediately told to put his clothes back on.

A TSA agent told him that he was committing indecent exposure, which is pretty far-fetched considering New York is one of at least two states in the country where a woman can legally be topless in public.

With the words "Down With Big Sis" scrawled on his naked back, Jon argued that he was not breaking the law nor TSA policy.

Then another TSA agent ordered him to turn off the camera - which we all know is an unlawful order.

The TSA agent ended up turning the camera away from the scene, so we're only able to hear the audio.

Jon argues his right to videotape the TSA screening area, but the TSA agents are clueless and are waiting for Port Authority police to show up.

Police and TSA officials spend the next few minutes ordering him to put his clothes back on, but he continues arguing his right to wear nothing but Speedos.

Then they turn off the camera and Jon informs us that is when they threatened to arrest him with disorderly conduct - the old contempt-of-cop standby.

But Jon points out that he was, in fact, not committing disorderly conduct, according to the actual New York statute, which states the following:

A person is guilty of disorderly conduct when, with intent to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereof:

1. He engages in fighting or in violent, tumultuous or threatening behavior;  or

2. He makes unreasonable noise;  or

3. In a public place, he uses abusive or obscene language, or makes an obscene gesture;  or

4. Without lawful authority, he disturbs any lawful assembly or meeting of persons;  or

5. He obstructs vehicular or pedestrian traffic;  or

6. He congregates with other persons in a public place and refuses to comply with a lawful order of the police to disperse;  or

7. He creates a hazardous or physically offensive condition by any act which serves no legitimate purpose.

He eventually turns the camera back on where we hear TSA officials tell him that they have contacted Jetblue security, who eventually ban him permanently from ever flying on the airline again because they believe he could be "a risk" once the plane is in flight.

But Jon has walked through TSA in his Speedos at least twice before, including last month in Salt Lake City where he had some trouble, but they eventually let him walk through and a second time at LAX International Airport in Los Angeles where nobody said a word to him.

He gave hopped-up security guards trouble by actually asserting his rights. Clearly, a threat to air safety.

Carlos, about one thing you are wrong: New York isn't the only state in which it is legal for a woman to go bare chested. Florida, North Carolina and Ohio are among those states with similar laws. I'm not sure how Ohio came to be among them, but in the cases of both Florida and North Carolina, the state supreme court has ruled that the indecent exposure law, which refers to genitalia, cannot be applied to a woman's breasts, since they are not genitalia. As with the case of photography, a woman might still be cited, but any attorney with an IQ above 6 can get the case dismissed.

MC,

I've written about the topless issue before and from my research, NY is the only state where women are allowed to walk around topless.

It is tolerated on some parts of South Beach, but it is not legal in Florida.

The top link is my article and the second link is from the NY Daily News that also states that NY is the only state where women can walk around topless.

Carlos, you may want to do a little more research.
A 1991 court ruling says it's ok in Ohio because female breasts are not "private parts."

And...the rest of the list took less than a minute to find.

I expect more from you, because I usually get more.

Well sorry to let you down. The article has been updated.

You never let us down. I, for one, really appreciate what you're doing for the community and our rights as american citizens. I know that there are a lot of people who do...

Reading your blog, and now your pixiq posts has really enlightened me to know what is actually allowed (it is more than i had originally thought), and encouraged me to investigate the statutes which govern and/or restrict our privileges.

It is also tolerated in some parts of Austin Texas (or the surrounding Travis County). For one, Hippie Hollow is the only "clothing optional" nude beach in Texas, but in other areas toplessness is permissible.

I believe that it is similar to the statute where it is illegal to expose genitalia, as Michael mentioned above.

What do you expect from an airline that made their plane divert and haul off a passenger in handcuffs just because she wouldn't delete a video she took of a fight.

Right on, all we need is one Patriot a day

to have fun with these blue-gloved weenies.

Next in line...

They are well within their rights to ban him if they don't like what he is doing. He doesn't have to fly, he can take a train, a bus, a car, a bike etc etc etc.

Funny, TSA didn't have a problem with this:
