What are the odds of me getting arrested this weekend?
It was last Memorial Day Weekend where I ended up going to jail for photographing a Miami Beach police officer against his wishes.
I was one of 548 people arrested that weekend which is an extraordinary number considering most of the arrests take place within an area that is 12 blocks long and two blocks wide.
And this year, the Miami Beach Police Department, along with 15 outside police agencies, will be donning the streets again arresting anybody who even looks at them the wrong way.
I wrote a lengthy piece on Miami Beach 411 about what locals and visitors can expect this weekend on Miami Beach.
And I might head out there on Saturday to take some pictures and shoot some video. This time, the video camera will remain on me throughout the night.
Last year, I had put it away and was focusing only on still photos because I had spent the afternoon shooting video.
If they’re going to harass me, I’m going to get it on video. And that includes you, Officer David Socarras.
And speaking of the Miami Beach Police Department. Remember that cop who shot and killed two unarmed men in the space of four days?
He was just arrested for operating a marijuana grow house in his home.
They sure do know how to pick them, don’t they?

I am guessing 80/20 in favour of you getting arrested. would be higher but they have likely circulated your pic and a few of them will remember to arrest other folks instead.

Funny how folks complain about the quality of police officers, yet have never offered to spend any of their life providing the service themselves. If you and others consider yourself good and decent folks, why aren’t you folks applying at various departments and trying to make a change from within?
This is the typical attitude of most of the country. We have police in lots of major metro areas making $50-$100K/year, with awesome benefits, and they still can’t get that many people to apply. We are left with various subsets of the population, and then folks complain when bottom of the barrel hires end up doing something stupid. Like this wasn’t to be expected?
I applied for a decent size suburban department in the Indy metro area. Pay after five years was $55K/year, 20 year retirement where you get _half_ your salary during retirement, take home police vehicle, over time is basically guaranteed, plus the ability to work part-time making $20-$30/hour. So after five years, your are easily pulling in $65Kish in benefits in a very low cost of living area.
They were lucky to get 150 to show up for the physical agility test. This is in an area with an MSA population of 1.2 MILLION people. Of those 150, I estimate that 10-20 were from out-of-state, and another 10-20 were from outside the Indy MSA. Not only that, about half of the folks are the same faces you will see at other PD hiring processes.
So jobs paying $65K/year after five years, in this economy, in urban areas with populations of over 1M can only muster to get about 100-110 people from that population to even show up for the physical.
And folks wonder why we have problems in LE.
I’m not sure what your point is in describing the compensation package of the job, but I think the point of the posting/blog is to point out the fact that there a lot of corrupt police out there and to expose those bad cops.
They spoil the reputation of the good cops and violate the rights of law abiding people. These bad cops need to be exposed and fired from their positions of trust. To say; if you have a problem with the police you should become a cop, is kinda like saying; if you don’t like the health system, become a doctor.
Their are a lot of problems in this world, we can’t get employment in all of those areas, but people can speak up when they can. Also, as in Carlos’ case, some sacrifice their time, money, and possibly freedom.
Don’t touch them. Don’t get near them. Back away if they approach you. You don’t want a battery charge. Have a friend with you who can record every word as well. Don’t get drunk.
You should be fine.
It’s not so much a complaint about the “quality” of a police officer, as it is a complaint that they aren’t following the basic rules which apply to the position. If they were doing their job correctly, but not to the best of their abilities then it would be a quality issue, this however is not the case when they violate laws they are there to enforce.

Good idea always having the video camera on, but you should also have a video camera “on you”. Have somebody staying a safe distance away filming you, as you film your subjects.
OH! You did! Good for you. Give us a rundown on how many people you’ve arrested for “contempt of cop”.
Yes. You need a “backup”.
Don’t forget to have the US Constitution in your pocket if they ask you for your “permit.”
In addition to your video camera, connect it to a wireless A/V transmitter which is being captured by a comfederate nearby, but far enough to be out of the cops’ awareness zone. So in addition to your original pics and vids on your memory cards, you can have your confederate upload the video while the cops are busy holding your camera gear indefinitely. You might also want to consider a pen camcorder strategically placed in your front pocket running at all times.
I’ve thought about it, but I couldn’t enforce laws I don’t agree with, so I would be kicked off the force in short order I’d imagine.

Maybe it’s because – for starters – college educated individuals who don’t have their heads up their asses aren’t too hep on having their political views used against them in the hiring process.
On a whim last year, my boyfriend picked up an app from a local municipal police department, as well as filled out some preliminary paperwork to become a State Trooper. The hiring process and training is catered to the exact types of individuals who can’t function with the public: bullies, anti-social freaks, ex-military who never readjusted to civilian life, people who have no attachments, are so out of touch with everything, have nothing to lose, and are willing to “just follow orders.” These are people who see nothing wrong with being required to give detailed information about their political beliefs and have no problems with paramilitary training.
Oh, silly me, I forgot, it’s all because we’re just, like whiners and stuff!

The majority of cops are OK, the problem is you will not encounter them because they they will leave you alone. Its the ass holes you will deal with, because they will seek you out, this is what they do and how they get off. Use care, as they have long memories and carry grudges. It would be wise to have wetness at all times and a spy camera radio linked to a remote site so there can be no accidental eraser.
If I was there I would follow you around with a video camera to document any trouble that might happen (just for your protection). I recommend that you find someone to help you and that they video you from a safe distance. That would prevent any loss of evidence in case someone deletes your camera card/disc. As a citizen, no one has to spend their life on a police force to simply expect our freedoms and rights to be upheld and protected by professionals. Likewise, we don’t have to be on a police force to be “good and decent”. Your rambling comments about job opportunities are irrelevant to this issue but I do wonder if you were ever actually hired for any of the positions for which you applied? By the way, what fear led you to not use your real name?
Carlos, I pulled out my magic 8 ball for this… “It is decidedly so”.
That depends. If you’re a well-behaved subject of the American crown, then you should be fine. If you insist on invoking constitutional rights, as if the constitution was actually a legally binding document, then you might get arrested.
Just make sure you file lawsuits for your previous two arrests in a timely fashion! The statute of limitations isn’t forever!
50/50 that you get arrested only because most of the cops know who you are now.
You should start putting notches on your camera for each time you’ve been arrested and had the charges dropped with a pro se defense.
And if you lose a couple of teeth in the deal all the better!!
It’s best to have someone else with you. Really there are other dangers out there besides the police (traffic, muggers, potholes) and a buddy can help with all of them.
You just don’t get it! Most normal people would not obey the orders cops are given by their masters. Most people would only arrest real criminals, issue tickets to only bad drivers, and treat the good citizens with respect. Instead, the cops set up speed cameras in school zones when school is not in session and thousands get bogus tickets in the mail. They stop drivers who are driving the speed limit and claim they are not wearing seatbelts when in fact they never took it off. They raid homes with full military assault gear and kill a sleeping seven year old girl in cold blood. After 20 years of “service” they have destroyed hundreds of families, got thousands of people fired from their jobs, put hundreds of innocent people in prison, and likely killed a number of people too.
No, most normal humans will not do that sort of job and you really can’t blame us. Only the Harvard/Yale elites (super rich) and their “bought” politicians are grateful to this “service” rendered. The rest of us are sick of it. We are sick of nothing being done about real criminals while we are treated like cattle.

You just proved my point. The only way to become one of the “masters” is to join up and work your way up through the ranks. As far as all the incidents listed, only a small % of cops do those things. You folks hear about those things because there is a small % of power hungry, full throttle cops out there. A good number of them were hired because many good, decent laid back folks took a pass on the job. You hear about them because it is a pure numbers game: The more you do, the more chance of something going wrong. With the bad comes the good, and more and more of the good officers are getting sick of doing _anything_ extra outside of taking their runs. There are many reasons why this is. Google ‘Depolicing’ or ‘De-policing’ and read up.

My “rambling comments” are not irrelevant. Only those who demand others wear the badge and do the job usually make such a statement. To those types, they could _never_ do the job, but they damn sure want others to do it…and then Monday morning quarterback the current state of law enforcement.
The comments I have read here show me there is a huge disconnect between what really happens in LE and how most folks outside view LE. In most major cities, all one has to do is take their runs/calls for service, and that is about it. If I got on the Indy Metro PD, I could just take my beat runs and I would never get called out for not writing a ticket, etc. Why? Because the ghetto is full of fools who steal, cheat, fight, shoot, kill, etc..
I never took the municipal policing job I applied for. I dropped out because while it would have been a 20% increase in pay from my current LE job, it would have been 300-400% more work load. I like laying low, patrolling until I am called for something. I am not big into traffic at all. My last ticket was in 2009. Being a libertarian, I am not big into the drug war. I basically like my current LE job, which is cake, so I stayed.
There are cops that we read about on this blog in every department. Then there are cops like me, and somewhat like me, and others that are totally different, in every department. The fact is, I joined up, and I have made a difference. I have educated some younger officers when they had no clue about the law, when they would have violated someone’s rights had they continued on their path. I have had people taking photos of me, and I just continued on my way. I have had calls where people called in “someone taking photos.” I have responded, and in most cases, never even got out of my car. In those that I did, I just asked what they were doing. They had every right to tell me to “F-off” and I would have just left, but since I was nice, I guess they were too…because most told me their reason. I never demanded ID, or anything like that. I am about as pro-freedom as they come, and if me and others like me start passing on doing the job, we will be left with anti-rights, “I am KING!” cops attitudes.
Being a cop isn’t a birth right. If you are a citizen of your county, town, city, and state, _you_ are part of the LEO employment pool every time a hiring process starts. Every time you take a pass, encourage your kids to take a pass, etc., that means someone who doesn’t think like you, act like you, etc. now has a better chance at getting the job.
We get what we ask for. If you want to make a change, join up, run for political office, and/or go to law school and file lawsuits with your own money, become a judge, become a prosecutor/DA, etc.. Sitting around on a blog complaining won’t change anything.

When you hire idiots, people with personality disorders, etc., that is a quality issue. Why? Because those same folks are the ones who can’t seem to follow the basic rules. It isn’t a good sign when 10%, 20%, ?% of our LEO have issues, but when the applicant pool is so tiny, what do you expect?
I see then, that you have come to appreciate the problem Carlos faces. It is the “idiots” from the tiny applicant pool that he is concerned about, and not the majority of qualified law enforcement officers.
We should get a pool going guys… I have $20 on Carlos getting arrested. If I win, I’ll donate 100% my winnings to his legal fund.
If he keeps the camera rolling he will be ok because he will be afraid to break any more laws because it will be on tape.
Oscar, some of those goons will just confiscate the camera as well. That’s one of the big problems with this whole business, they have no regard for the 4th Amendment.

I more or less agree. And on top of that I’d REALLY rather politics in another forum. The central issue here is the rights of photographers and the way they are treated by the police. Let’s focus on that.
