Woman Claims She Was Assaulted For Photographing McDonald's Menu
We’ve learned that we’re not allowed to take pictures in Burger King.
And now we’re learning that we are allowed to take pictures in McDonald’s.
Not that it won’t get you assaulted.
An American woman traveling in Paris last year said a McDonald’s employee assaulted her after she photographed the menu behind the counter.
Penny Sheldon of Idaho tells travel writer Christopher Elliott the following:
My husband and I were visiting Paris last spring. We saw a McDonald’s and wanted to take a picture of the menu board to show my six-year-old grandson. I knew he’d get a kick out of seeing how different it appeared from a McDonald’s in the United States.
I went directly to the counter and took a picture of the menu board and turned around to leave. A woman behind the counter said something in French which I didn’t understand. Assuming she asked me if I wanted to order something I acknowledged her by saying, “Non, merci.”
As I reached the door this same woman was right be hind me yelling and screaming in French. She grabbed me by my arm and jacket and threw my back against the open door, all the while grabbing at different parts of my coat with one hand and pinning me there with another. Within seconds another woman appeared at the scene and put her arm across my chest.
According to Elliott, French law permit public photography but requires the subject to give consent before the photo is published.
He also learned that McDonald’s does allow people to photograph their menus, unlike their main competitor.
However, Photography is Not a Crime reader PeaceableGuy contacted Burger King’s corporate office and learned there is no official policy banning photography at its restaurants, according to this comment.
The information received by calling BK corporate at (305) 378-3535 is that such "no videotaping or photography permitted" is NOT a corporate-level policy.
It was suggested that the policy was store-level (though based on the official-looking quality of the sign, I suspect there's a bit more to it than that - perhaps a corporate-level policy *option*), and that the specific store in question is the proper venue to find further information about said policy.

How much should you charge for a photograph?

Comments
The article takes aim at what Penny could have done better, makes up unfounded possibilities and even questions her veracity. Yeah, thanks a lot! Paris should be used to foreign tourists by now. The stereotypical ugly American gets the stereotypical rude treatment from a Parisian and the cold shoulder of the cops. Chances are there are security tapes, you know, photography in action. I see no inconsistency with her story of snapping a shot of the menu, and being assaulted by a McZealot. The US embassy should push the local cops to review the tapes and press charges against the McZealot.
Thanks! Maybe you had to be there but it really was one of the scariest things I've ever been through including car wrecks and an announcement on a plane that
we had an emergency landing due to a fire in the belly. I've never been "attacked" before and I can't believe how physically painful it was plus leaving such a sense of vulnerability in a foreign country. And I'm a seasoned traveler.
The woman didn't give me any opportunity to do anything but yell for help to my husband who was across the street. When she saw him coming she dragged me over to a post where she pinned me with the help of another woman. My husband had to stand between me and these women to keep their hands off me.
seems they also have signs at BK informing everyone that they are being photographed and video'd, so its fine and legal for them to do it to you, but illegal for you to film..etc. them, does anyone see anything, I MEAN ANYTHING wrong with that? i sure as fuck do, BK go fuck yourself and your stupid signs!
and now the big macs have no signs but are doing this shit, but it is in france. we all know those french are crazy, so chalk this up to them really crazy and go on from there! remember they never started or was a war they had any chance of winning, the only thing they do good is run away and hide.....LOL
I am the victim here. I own a very successful travel agency and have traveled the world over extensively. Taking a picture for a child is a very innocuous act that should not receive such physical damage. I had bruses on my wrist, arm and tailbone. My tailbone was crushed and the doctor said the pain may never go away.
The first thing we did was call 17 on my husband's cell - the equivalent to our 911 #. We were told they didn't speak English and couldn't help us. We went back to our hotel and asked them to call the police and we were told that's not the way it worked in France. We were instructed to go to the police department close to McDonalds and file a report.
When we reached the police station the officer standing outside spoke a few words in English and stated that he couldn’t take a report. He said that only his commander could take the report and he was going to be off duty in a few minutes so he didn't have time. We said we wanted to file an assault report and needed the police to go with us so we could identify my attackers. He said he couldn’t do that as we were in the wrong district.
My husband then sent a brief email to the Mc Donald's headquarters in Illinois stating that he wanted to speak with someone as I had been assaulted and received the following answer.
Thank you for taking the time to contact McDonald's.
I sincerely apologize for your recent experience at one of our restaurants in France. At every McDonald's around the world, we strive to deliver 100-percent total customer satisfaction. Many steps are taken in our training and operational programs to always provide hot, fresh food, served quickly at a good value in a clean environment. However, from your e-mail, it appears as though we've let you down.
I've shared your comments with our corporate office in France that oversees the restaurants in this country. I'm certain your concerns will be addressed immediately, so that your future visits to McDonald's can be more enjoyable. If you still wish to contact our office in France, please visit http://www.mcdonalds.com/conta... for a list of our international offices, or they can be reached at:

We also tried to file a report with the American Embassy. We reached a Gilda House who took the information but said we really needed to get hold of Mc Donald’s . Since it was a holiday she was the only one on duty to take reports. She said she would email a report to me. Following our return home I tried to contact her at the American Embassy and received a response from another person stating that it would take from six months to a year to get a copy after I sent a request letter directly to the Embassy
Placing the call immediately my husband reached a recording stating that they were closed due to a religious holiday.
Yes Mc Donald's I'm sure my next experience could be more enjoyable! Do you want your hambuger with or with out an attack?! How could you let me down any better than a good hard shove?
Penny,
Rather than write the US Embassy in Paris, I would write the US Department of State in Washington DC and ask Clinton to file an immediate official complaint with France. I would also send a copy to the French Embassy in Washington DC, asking them to immediately intercede with the Paris Police to identify your assailant. I would also copy the major newspapers in Paris, asking why the French permit tourists to be assaulted over a picture, that clearly does not contain any person, just the menu.
A letter to the McDonald's CEO, Chairman of the Board and each Board Member may also help.
Also - We can write a letter to the French Embassy indicating that we do not understand their inability to react to and process as simple complaint, and that we will not be vacationing in france (lower case on purpose) any time soon.
God gave us fists for more than just pumping them in the air to signal victory.
PENNY:
i wouldnt go to france for nothing, not now hearing what happened to you, it could have happen anywhere some may say, but shit, the police acting like it aint nothing, they as bad as them big MACS over there in that junk food place PENNY was attacked by the people running the damn place, thing is they more then lightly wouldnt have done that shit to a citizen of that country, but we all know they hate us over there in france! maybe this is the first time this ever happened to PENNY in france, but i got to figure this is the last she goes there unless her job dictates it.
hope you get and feel better soon, Penny, and sorry to hear this happening to you.
